The aggregate sum of both bonds shall therefore equal 200% of the total contract price. A further guaranty (surety) accompanying all bids shall be given in the amount of ten percent (10%) of the bid, but not in excess of twenty thousand dollars ($20,000.00) made payable to the "City of South Amboy" and shall be given in the form of a Certified Check, Cashier's Check or Original Bid Bond from a reputable insurance company. THIS 10% GUARANTY IS MANDATORY. Bidders are required to comply with all applicable statutory requirements including the requirements of N.J.S.A. 10:5-31, et seq. and N.J.A.C. 17:27, et seq. (the Davis Bacon Act) and the regulations thereunder, and N.J.S.A. 52:32-44, et seq. (New Jersey Business Registration). In addition, bidders are informed that this is a federally funded project and all pertinent federal laws, regulations, and reporting requirements apply to the bidding for and performance of the proposed contract including 8% Disadvantage Business Enterprise (DBE) goal and 7 Training Positions [where feasible, consisting of at least Three (3) Apprentices and Four (4) Trainees], totaling 4,680 hours. The Contractor will be required to execute a Project Labor Agreement (PLA) with the City and applicable Unions, in the form provided within the Proposal Section of this RFP and shall return an executed Letter of Assent with their bid submission. Proposals are being solicited through a fair and open process in accordance with N.J.S.A. 19.44A.20.2 et seq. and as such contractors are exempt from the limitations on making political contributions under that law.
