Renovation of a mixed-use development in Livermore, California. Completed plans call for the renovation of a municipal facility.

City reserves the right to reject any and all bids and to waive any non-substantive irregularities. The Project is located at 1110 S. Livermore Avenue in the Civic Center Central Plant located in the secured back parking lot of the City of Livermore Police Department as well as at various locations within the Police Department and at 1052 S. Livermore Avenue in City Hall and is described as follows: replacement and upgrades of various components of the City Hall and Police Department's HVAC system including but not limited to replacement of two chillers and three boilers with supporting equipment in the Central Plant; new mechanical/plumbing units with seismic restraints system; remove and replace three boiler pumps with new boiler venting and provide DDC controls for new boilers; add mini-split systems at 911 and Main IT Rooms and upgrade HVAC Control System from pneumatic to DDC at Police Department and Central Plant to DDC controls, update DDC control at City Hall and incorporate CO2 controls. 3.2. Time for Completion. The planned timeframe for Substantial Completion of construction of the Project is 320 Working Days after the commencement date stated in the Notice to Proceed. Final Completion of the Project is planned to be 40 Working Days after the date of Substantial Completion. 4. Specific Brand. In City of Livermore Resolution No. 2022-088, as authorized by Public Contract Code, Section 3400(c), the City has found that the following specific brands are required for the following particular material(s), product(s), thing(s), or service(s), and no substitutions will be considered or accepted: Items: Campus Building Controller Software Upgrade; Building CO2 Sensor Zones; Police Department Upgraded Pneumatic Actuators; and Building Controllers - Brand Required: SIEMENS 5. Construction Cost. The Engineer's estimated construction cost is: $4,400,000. 6. License and Registration Requirements. 6.1. License. At the time of bid opening and for the duration of the Project, Contractor shall possess a valid California contractor's license for the following classification(s): Class B Contractor's License (See also, Instructions for Bidders, Section 4, Licenses and DIR Registration.) In addition, at the time of bid opening and for the duration of the Project, the Contractor or his subcontractors shall possess a valid California contractor's license for the following classification(s): Class C36 Contractor's License for the plumbing subcontractor and both Class C4 and C20 Licenses for the mechanical subcontractor. A bid submitted by a bidder that does not possess any of these licenses at bid opening may render the bid non-responsive, barring award of the Contract to that bidder. The Contractor is reminded to complete the Bidder's Questionnaire in accordance with the Instructions to Bidders for the Contractor and the plumbing and mechanical subcontractors and submit with the Bid Proposal, using the form provided by City. 6.2. DIR Registration. City will not accept a Bid Proposal from or enter into the Contract with a bidder without proof that the bidder and its Subcontractors are registered with the California Department of Industrial Relations ("DIR") to perform public work under Labor Code Section 1725.5, subject to limited legal exceptions. Bid Clarifications. Questions regarding the Project, the bid procedures, or the meaning or intent of the Contract Documents must be submitted in writing to the Engineer at Mike Cavalieri, Special Projects Coordinator 1052 S. Livermore Avenue, Livermore CA, 94550 mtcavalieri@livermoreca.gov Any responses deemed necessary by the Engineer will be provided in a written addendum to be posted on Ebid and the City's website. Questions received less than seven days before the deadline for bid submission might not be answered. Only a written response issued in an addendum will become part of the Contract Documents. Oral responses will have no legal effect. Subject to the limitations of Public Contract Code, Section 4104.5, City reserves the right to issue addenda before the time of the bid opening. Bid Proposal and Security. 10.1. Bid Proposal Form. Each bid must be submitted using the Bid Proposal form contained as a part of the Contract Documents. 10.2. Bid Security. Each Bid Proposal must be accompanied by bid security of ten percent of the maximum bid amount, in the form of a cashier's or certified check made payable to City, or a bid bond executed by a surety licensed to do business in the State of California on the Bid Bond form included in the Contract Documents. The bid security must guarantee that within ten days after City issues the Apparent Low Bidder Notice ("ALB Notice"), the bidder must execute the Contract and submit payment and performance bonds, warranty bonds, insurance certificates and endorsements, as required by the Contract Documents. 11. Prevailing Wage Requirements. 11.1. General. This Project is subject to the prevailing wage requirements applicable to the locality in which the Work is to be performed for each craft, classification or type of worker needed to perform the Work, including employer payments for health and welfare, pension, vacation, apprenticeship and similar purposes. The Contract will be subject to compliance monitoring and enforcement by the California Department of Industrial Relations, under Labor Code, Section 1771.4. 11.2. Rates. The prevailing rates are available online at http://www.dir.ca.gov/DLSR. Each Contractor and Subcontractor must pay no less than the specified rates to all workers employed to work on the Project. The schedule of per diem wages is based upon a working day of eight hours. The rate for holiday and overtime work must be at least time and one-half. 12. Performance, Payment, and Warranty Bonds. The successful bidder will be required to provide performance and payment bonds each in the amount of 100% of the Contract Price and a Warranty Bond in the amount of 15% of the Contract Price. 13. Extraordinary Insurance Requirements. The Contractor's attention is directed to the Completed Operations insurance requirements in the Appendix of Forms which requires the Contractor and subcontractors to maintain insurance as required by this contract for a minimum of five years following the completion of this project all in accordance with the insurance requirements in the Appendix of Forms. 14. Substitution of Securities. Substitution of appropriate securities in lieu of retention amounts from Progress Payments is permitted under Public Contract Code, Section 22300 which requires use of the escrow agreement language provided at subsection (f) of Public Contract Code Section 22300, which is the Escrow Form included in the Appendix portion of the Contract documents. 15. Subcontractor List. Each bidder must submit the name, location of the place of business, California contractor license number, and California Department of Industrial Relations registration number of each First Tier Subcontractor who will perform work or service or fabricate or install work for the prime contractor ("Subcontractor Services") in excess of one-half of 1% of the bid price, using the Subcontractor List form included with the Contract Documents. The same requirement applies to each First Tier Subcontractor who will perform Subcontractor Services in excess of either one-half of one percent of the bid price or $10,000 for the construction of streets, highways or bridges.
