The successful bidder will be required to execute Contract and to provide Contract Surety in an amount equal to one hundred (100) percent of the bid amount for performance, and a bond in the amount equal to one hundred (100) percent of the bid amount guaranteeing the payment of all labor, materials, etc. Rights to waive any formality in any proposed guarantee, to reject any and all bids, and to negotiate with the apparent low bidder to such extent as may be necessary, are reserved. No bidder may withdraw his bid for a period of one hundred twenty (120) calendar days after the scheduled closing time for the receipt of bids. Bids may be held by the Fleming-Mason Airport Board for a period not to exceed one hundred twenty (120) calendar days from the date of the bid opening for the purpose of evaluating bids prior to award of contract The award shall be issued on the lowest responsive bid by a qualified bidder. Award of the contract will be made to the bidder with the lowest total cost to the owner based on funds available. The funds allocated for the performance of this contract are limited. The owner reserves the right to limit the work, either by elimination of the items or reduction in quantities, to stay within the limit of available funds. The contractor shall perform, with his organization, an amount of work equal to at least 30 percent of the total contract cost. The contractor shall be prequalified (if applicable) with KYTC (must show proof at the time of bid) for those items of work which account for at least 30 percent of the contract costs. All subcontractors performing work on this project must be prequalified (if applicable) with KYTC (must show proof prior to construction) for those items of work to be performed for the contractor.
