Sealed bids for the construction of Crow Creek Trail will be received by Upper Merion Township. The project in Upper Merion Township, Montgomery County, PA will involve construction of approximately 8,000 linear feet of asphalt multi-use trail along or in the vicinity of Crow Creek. Other proposed features include two steel pedestrian bridges, two timber pedestrian bridges, segmental retaining walls, stormwater management infiltration basins and underground infiltration bed, sidewalk and curb ramps, crosswalk improvements with one flashing warning beacon, and temporary stream crossing. Each bid must be accompanied by a bid bond or a certified check in an amount not less than ten percent (10%) of the amount of the bid in the form and subject to the conditions provided in the Instructions to Bidders. No bid may be withdrawn for the period of days stated in the bid form from the date the bids are opened. The successful bidder will be required to furnish satisfactory Performance and Payment Bonds in the amount of 100% of the Contract amount and a Maintenance Bond in the amount equal to fifteen percent (15%) of the contract amount, thereafter required on the specified Bond Forms included in the Contract Documents and Waiver of Lien. The right is reserved to waive any informality in the Bid, to reject any or all Bids, and to accept any Bid which is deemed most favorable to the Owner, at the time and under the circumstances stipulated. The work in this contract shall be paid for in accordance with the Pennsylvania Prevailing Wage Act (Act No. 442) Due to the ongoing COVID-19 pandemic, no pre-bid conference has been scheduled. The Site is identified in the Bidding Documents. Easements for permanent structures or permanent changes in existing facilities are to be obtained and paid for by Owner unless otherwise provided in the Bidding Documents. All additional lands and access thereto required for temporary construction facilities, construction equipment, or storage of materials and equipment to be incorporated in the Work are to be obtained and paid for by Contractor. All questions about the meaning or intent of the Bidding Documents are to be directed to the Engineer. Interpretations or clarifications considered necessary by Engineer in response to such questions will be by Addenda. Notifications of Addenda will be emailed to all parties recorded by Engineer or Owner as having received the Bidding Documents. Questions received after the posted cut-off date of 12:00pm local time on Friday, August 21, 2020 will not be answered. Only questions answered by Addenda will be binding. Oral and other interpretations or clarifications will be without legal effect. Owner reserves the right to reject any or all Bids, including, without limitation, nonconforming, nonresponsive, unbalanced, or conditional Bids. Owner further reserves the right to reject the Bid of any Bidder whom it finds, after reasonable inquiry and evaluation, to not be responsible. Owner may also reject the Bid of any Bidder if Owner believes that it would not be in the best interest of the Project to make an award to that Bidder due to noncompliance with Bid Specifications and/or prior work history of the Bidder. Owner also reserves the right to waive any informalities not involving price, time, or changes in the Work and to negotiate contract terms with the Successful Bidder. The successful Bidder shall be required to enter into a written Contract in form to be approved by the Owner.
