Proposals must be submitted on blank forms provided in the bound copies of the Contract Documents for all work required. The Street Improvement Projects - Division DD and other paving work for the City of Statesville on which Proposals are requested, include the following major items: Milling Super pave S9.5B Asphalt Bituminous Surface Treatment Each Proposal shall be accompanied by a certified or cashiers check payable to the order of the Owner, or a satisfactory bid bond executed by the Bidder and a surety company, in the amount not less than 5% of the bid as a guarantee that the Bidder will within ten (10) days after the date of the Bidders receipt of the Notice of Award of a contract execute an agreement and file bonds and insurance as required by the Contract Documents if his Proposal is accepted. If a Bidder fails to execute and file an agreement, bond and insurance, the amount of the security shall be forfeited as liquidated damages. A performance bond will be required of the successful Bidder in an amount equal to one hundred (100) percent of the amount of the Contract, conditioned upon the faithful performance of the Contract and to the payment in full to all persons furnishing labor, materials, equipment, etc., for and in connection with the work to be performed under the Contract. A 100% payment bond will be required in addition to a 100% performance bond. A 200% performance-payment bond is acceptable in lieu of the above. The City reserves the right to reject any Proposal for failure to comply with all requirements of this notice or of any of the Contract Documents; however, it may waive any minor defects or informalities at its discretion. The City further reserves the right to reject any and all Proposals or to award a Contract, which in its judgment is in the best interest of the City. No bid shall be withdrawn after the opening of Proposals without the consent of the Owner for a period of 60 days after the scheduled time of closing bids. The City of Statesville reserves the right to extend the Division CC Contract to include additional streets as deemed to be in the best interest of the City of Statesville. The City reserves the right to incorporate the subsequent year's resurfacing contract and other City related paving work, such as City-owned parking lots, other streets similar to this contract, and petitioned street improvements. The Contract Documents, Contract Drawings and Specifications are on file and available for inspection during normal business hours between 8:00 A.M. and 5:00 P.M., Monday through Friday, at the following locations: Office of the Director of Public Works, City Office Building, 301 South Center Street, Statesville, North Carolina 28687-1111. The full amount of the deposit for one set of documents and one-half of the deposit for any additional sets of documents will be refunded to each Bidder who submits a formal proposal to the Owner, and who also returns the documents in good condition to the Engineers office within ten (10) days after his bid security has been returned to him.
