A pre-bid conference will not be conducted, and bidders will not be prequalified. The letting of the work described herein is subject to the provisions of the Iowa Statutes. The Work under the Contract for each section shall commence on or before the date specified in a written Notice to Proceed and shall be fully completed and ready for operation on or before August 2, 2019. Bidder accepts the provisions of the Agreement as to Liquidated Damages of $1,000.00 per day for Final Completion in the event of failure to complete the Work within the Contract Time. Payment for the Work completed will be determined by the Engineer pursuant to the General Conditions and in accordance with the provisions of Chapter 573 Code of Iowa. The OWNER reserves the right to increase or decrease the quantity of any item or portion of the work, or to omit portions of the work, as may be deemed necessary by the OWNER, and the same shall in no way affect or make void the contract, except that additions to, or deductions from, the contract price will be appropriately made. The OWNER reserves the right to waive any informalities, or to reject any or all bids, or any part of a bid,and to award the Contract to the Bidder, who in the judgment of the OWNER, will best serve the interest of the OWNER.
