No oral response to any question by any City of Newark employee or agent shall be binding on the City of Newark or in any way considered to be a commitment by the City of Newark. Sealed Bids must be (1) made on the standard proposal form included in the bid package, and enclosed in specially addressed and sealed enveloped indicating the project name and number, (2) accompanied by a certified check drawn to order of the City of Newark or a Bid Bond in the amount often (10%) percent of the total bid, not to exceed $20,000.00 (Twenty Thousand Dollars and Zero Cents), (3) accompanied by a Consent of Surety from a company authorized to do business in the State of New Jersey, and (4) accompanied by an executed non-collusion affidavit. The successful bidder will be required to furnish a Performance and/or Individual Surety Bonds prior to execution of the Contract by a Company authorized to do business in the State of New Jersey in the amount not less than one hundred (100%) percent of the Contract. All bid deposits, whether they be bonds or certified checks shall be made payable without condition to the City of Newark, which check or bond may be forfeited should the successful bidder fail to enter into a Contract with the City. All bidders must comply with the State of New Jersey Laws of 1971, Chapter 198, as amended relative to submission of a certification of the bidder indicating the ability to perform the contract. All contractors must comply with the requirements of Chapter 33 of the Laws of 1977, which requires disclosure of all stockholders owning 10%, or more of the corporate stock by executing the "DISCLOSURE CERTIFICATE" included in the specifications. The successful bidder shall be required to comply with the provisions of the New Jersey Prevailing Wage Act, Chapter 150 of the Laws of 1973, effective January 1,1974, Section 109 of PL 94-369, and Section 110 of PL 93-383 regarding wage rates determined by the Secretary of Labor, in accordance with the provisions of the Davis-Bacon Act as amended (40 USC 275a-276a-5) whichever provides for the higher rate of pay for each specific job classification. All proposals are subject to the requirements of all laws and City Ordinances affecting same. The bidder's attention is directed to Section 2:3-14 of the City Administrative Code. Bidders are also advised as to the applicability of the City's Affirmative Action Program, and must, during the performance of the Contract, comply with requirements of PL 1975 C. 127 (NJ.A.C. 17:27). If awarded a contract company/firm will be required to comply with the requirements of pl 1975, c.127 (njac 17:27). Pursuant to Newark City Ordinance #2:2-28.3 and 2:2-28.4, the contractor must set aside at least twenty-five per cent (25%) of the total contract bid price to a Minority owned Business Enterprise (MBE) or Enterprises plus an additional seven per cent (7%) to a Women owned Business Enterprise (WBE) or Enterprises; the total set aside (%) through either joint venture arrangements, partnerships, subcontracts, the purchase of goods and services or any other method available. The term (MBE) or (WBE) means a business independently owned and operated, as defined in City Ordinance 2:2-28.3 and 2:2-28.4, in which at least fifty-one (51%) percent of the stock is owned beneficially and controlled by persons who are African American, Hispanic, Asian American, American Indian or a Woman and certified as such by a governmental entity. Successful bidders will be required to attend a meeting with and obtain a clearance from the City's Office of Affirmative Action prior to execution of the contract. NOTE: the contractor can participate in the Newark Minority Resident Employment Incentive Program. A credit of 5% in contract (MBE) dollar commitment will be allowed, if a Newark domiciled Journey worker/apprentice is engaged in the performance of the contract. A credit of 2 man hours for every 8 man hours worked by a Newark domiciled Journey worker on any given day. The City accepts no responsibility for any bids prior to their presentation at the date and hour indicated for the formal bid opening. No bid will be accepted after the date and hour named. Bidders may not withdraw their respective bids for a period of sixty (60 days) days after the receipt of the same by the City of Newark unless otherwise permitted by statute. Based upon the specifications, the city reserves the right to reject any and all bids, to waive informalities and to award the contract to the lowest responsible bidder in a manner deemed in the best interests of the city.
