Any contract awarded under this Invitation for Bids will be funded in part by Texas Water Development Board, (TWDB) and is contingent on the release of funds from TWDB. Neither the State of Texas nor any of its departments, agencies, or employees are or will be a party to this Invitation For Bid, or any resulting contract. This project is subject to the American Iron and Steel (AIS) requirements of P.L. 113-76 Consolidated Appropriations Act, 2014. All iron and steel products for construction, alteration, maintenance, or repairs incorporated in these plans must be produced in the United States. This contract is subject to the Environmental Protection Agency's (EPA) Disadvantaged Business Enterprise (DBE) Program, which includes EPA-approved fair share goals toward procurement of Minority and Women-owned Business Enterprise (M/WBE) businesses. EPA rules require that applicants and prime contractors make a good faith effort to award a fair share of contracts, subcontracts, and procurements to M/WBEs through demonstration of the six affirmative steps.This contract is subject to, Davis-Bacon Act, Fair Labor Standards, Equal Employment Opportunity, Affirmative action and contracting with small, minority, and disadvantage firms, as detailed in the project manual.Each Bid shall be made on a form furnished by the Engineer and must be accompanied by bid security consisting of either a certified check, cashier's check, or a bid bond in an amount of not less than five per cent (5%) of the amount of the Bid and made payable to the Harris County Water Control and Improvement District No. 36, 903 Hollywood Street, Houston, Texas 77015.
