Runway & Taxiway Closure Bids shall be made in accordance with the Notice to Bidders, Instructions for Bidders, Plans, Specifications, and Bidder's Proposal, which are on file and available for examination at the City Clerk's Office in the City Hall and are made a part of this notice as though fully set forth herein. Bids shall also be made in accordance with the prevailing hourly rate of wages for their locality and project as determined by the U.S. Secretary of Labor on file in the Office of the U.S. Department of Labor. Not less than the prevailing wage scale shall be paid to any workman employed on this project pursu- ant to the provisions of the Da- vis Bacon Act (29 CFR Part 5) as amended and supplemented. All laborers and mechanics em- ployed by contractors and sub- contractors on projects funded directly by or assisted in whole or in part by and through the Federal Government pursuant to the FAA shall be paid wages at rates not less than those pre- vailing on projects of a char- acter similar in the locality as determined by the Secretary of Labor in accordance with sub- chapter IV of Chapter 31 of Title 40, United States Code. The Department of Labor pro- vides all pertinent information related to compliance with labor standards, including prevailing wage rates and instructions for reporting. A cashier's check, a certified check or a surety bond in the amount of five percent (5%) of the bid shall accompany the sealed proposal of each bidder. Deposits will be returned to the unsuccessful bidders. The Owner advertises for and accepts bids from the bidder with the understanding that the Owner's ability to accept the low bid submitted is contingent upon receiving a Federal Grant for this Project. Policies. It is the policy of the U.S. Department of Trans- portation (DOT) that disadvantaged business enterprises as defined in 49 CFR Part 26 shall have the maximum opportunity to participate in the performance of contracts financed in whole or in part with Federal funds. The goal for firms owned and controlled by socially and econom- ically disadvantaged individuals for this project is TBD of the dollar value of the contract. All bidders shall, with the submissions of their bid, show their intent to meet or exceed the DBE goal established for the project, or propose an adjusted goal accompanied by their sub- mission of good faith efforts. Failure to make the written assurance which includes the names of the DBEs used, the work they will perform, and the price for the work or failure to demonstrate good faith efforts to the City of Hobart to meet or exceed the DBE goal shall render a bid non-responsive. Information shall be provided in the specifications. If a bidder cannot meet the established DBE goal, the bid- der shall document and submit with their proposal, justification stating why he or she could not meet the established DBE goal and demonstrate its good faith efforts. To demonstrate good faith efforts to meet the DBE goal, the bidder shall document the steps taken to obtain DBE participation. The City of Hobart will review and determine that the information is complete and accurate and adequately documents the bidder's good faith effort before committing to the award of the contract to the bidder. The proposed contract is subject to the Foreign Trade Restriction - Denial of Public Works Contracts to Suppliers of Goods and Services of Coun- tries that Deny Procurement Market Access to U.S. Contractors under 49 CRF, Part 30 and Section 115 of the Airport Safe- ty Act. The restrictions extend to all projects for which funds are made available by that Act. The restrictions apply to all con- tracts entered into under grants authorized by the Airport Safety Act. BUY AMERICAN CER-TIFICATE (JAN. 1991). By submitting a bid/proposal un- der this solicitation, except for those items listed by the offeror on a separate and clearly iden- tified attachment to his or her bid proposal, the offeror certi- fies that steel and each manu- factured product, is produced in the United States (as defined in the clause Buy American - Steel and Manufactured Products or Buy American - American Steel and Manufactured Products for Construction Contracts) and that components of unknown origin are considered to have been produced or manufactured outside the United States. Offeror's at- tention is directed to the speci- fications for further information on the Buy American clause. FEDERAL REQUIREMENTS: 1) The proposed con- tract is under and subject to Executive Order 11246 of September 24, 1965, and to the Equal Oppor- tunity Clause. The Bidder's attention is called to the "Equal Opportunity Clause" and the "Standard Federal Equal Employment Opportunity Con- struction Contract Speci- fications" set forth in the Specifications. 2) The Bidder (Proposer) must supply all the information required by the bid or proposal form. 3) The successful bidder will be required to submit a Certification of Non-Segregated Facilities prior to award of the con- tract, and to notify prospective subcontractors of the requirement for such a Certification where the amount of the subcontract exceeds $10,000. Sam- ples of the Certification and Notice to Subcontrac- tors appear in the Specifications. 4) Women will be afforded equal opportunity in all areas of employ- ment. However, the employment of women shall not diminish the standards or requirements for the employment of minorities. 5) The proposed contract is subject to the Government Debarment and Suspension (DOT Regulation 49 CFR Part 29), Subpart F - Drug-Free Workplace Requirement (Grants). Notice of Requirement for Affirmative Action to Ensure Equal Employment Opportunity (Executive Order 11246, as amended). 1) The goals and time- tables for minority and female participation, ex- pressed in percentage terms for the contractor's aggregate work force in each trade on all construction work in the covered area, are as follows: Minority Participation: TBD Female Participation: TBD See the specifications for detailed information on this requirement. For contracts of $50,000 or more, a contractor having 50 or more employees and his subcontractors having 50 or more employees and who may be awarded a subcontract of $50,000.00 or more will be required to maintain an affirmative action program within 120 days of the commencement of the contract. Offerors are responsible for submitting proposals and any modifications or revisions, so as to reach the office designed in this solicitation by the time specified herein. Any proposal, modification, or revision re- ceived at the office designated in the solicitation after the ex- act time specified for receipt of offers is "late" and will not be considered. Bids received more than ninety-six (96) hours before the time set for opening of bids, excluding Saturdays, Sundays, and holidays, as well as bids received after the time set for opening of bids, will not be considered and will be returned unopened. Proposal and Affidavits must be made on Bidder's Proposal Form only. The bid shall be filed with the City Clerk's Office in City Hall. All proposals shall be either typewritten or written neatly in ink. Envelopes containing bids must be sealed, marked, and addressed as fol- lows: SEALED BID - HO- BART REGIONAL AIRPORT RECONSTRUCT NORTH AND CENTER CONNECT- ING TAXIWAYS AIP PROJ-ECT 3-40-0040-005-2019. Right is reserved, as the interest of the City of Hobart may require to reject any and all bids, and to waive any informality in bids received. All bidders must visit and inspect the construction site and be familiar with the physical characteristics and conditions at the construction site.
