Bidders are responsible for ensuring that their proposals are received in the office of the City Clerk by the time and date specified above. Any proposals that are not timely received in the office of the City Clerk shall be returned unopened. The general description of work includes placement of crack seal, slurry seal, traffic striping, pavement markings, pavement markers, removal of the existing raised median and placement of asphalt concrete in Vaca Valley Parkway at the intersection of East monte Vista Avenue/ Crocker Drive, and performance, placement, construction, or installation of such other items or details, not mentioned above, which are required by the Project Plans, Standard Specifications, or these Special Provisions No Pre-Bid Meeting is scheduled for this project. The Contractor shall possess a Class A license at the time a bid is submitted for this Project. This Contract is subject to State Contract Nondiscriminatory and Compliance Requirements pursuant to California Government Code, commencing with Section 12900 through Section 12996. The Project Plans, Special Provisions, and Proposal Forms for bidding this project shall only be obtained through BPXpress Reprographics, located at 4740 East Second Street #29, Benicia, CA 94510, (707) 745-3593, electronically. All bidders shall confirm that they have been included on the official plan holders list maintained by BPXpress Reprographics. Bids are required for the entire work described herein. Refer to Section 2, "Bidding" for details related to bid eligibility and the bidding process. The successful Bidder shall furnish a Payment Bond and a Performance Bond in the amount of 100% of the Contract amount within ten (10) calendar days from receipt of the Notice of Award letter. Refer to Section 3, "Contract Award and Execution" for details related to the contracting process, bond requirements, and surety notification. Pursuant to Section 1773 of the Labor Code, of the State of California, the general prevailing rate of per diem wages and the general prevailing rate for holiday and overtime work in the locality in which the public work is to be performed have been determined by the Director of the California Department of Industrial Relations. These wage rates are available upon request at the City of Vacaville's Public Works Department and are listed on the California Department of Industrial Relations electronically. In accordance with Section 1774 of the Labor Code, of the State of California, the contractor to whom the contract is awarded, and any subcontractor under him, shall pay not less than the specified prevailing rates of wages to all workmen employed in the execution of the contract. Refer to Section 7, "Legal Relations and Responsibility to the Public" for details regarding Labor Code compliance and payroll reporting. The Contractor may elect to receive 100% of payments due under the Contract document from time to time, without retention from any portion of the payment by the City, by depositing securities of equivalent value of the retained amount with the City in accordance with the provisions of Section 22300 of the Public Contract Code. Such securities, if deposited by the Contractor, shall be valued by the City, whose decision on valuation of the securities shall be final. Securities eligible for investment under this provision shall be limited to those listed in Section 22300 of the Public Contract Code and Section 16430 of the California Government Code. The Contractor shall indemnify and hold harmless the City from any and all loss or damage suffered by the City as a result of any wrongful or negligent act or omission on the part of the Contractor or any of its officers, employees or agents with respect to the performance for Escrow Agreement. The City reserves the right to reject any or all bids, and to determine which proposal is, in its judgment, the lowest responsive bid of a responsible bidder and which proposal should be accepted in the best interest of the City. The City also reserves the right to waive any irregularities in any proposal or bid. Proposals in which the prices are obviously unbalanced may be rejected.
