Site work for a warehouse / distribution facility in Sandy, Utah. Completed plans call for site work for a warehouse / distribution facility.

Salt and trash concrete bins at our new facilities building next to CAB West. The plans include concrete footings, foundations, metal panels on the sides, and a metal roof. Q & A deadline: May 29, 2019 2:00:00 PM EDT Bidders are required to submit to the Canyons School District a copy of their State of Utah license. The copy must be uploaded to BidSync at the time the bid is submitted. Changes orders: Changes to the Scope of work must be approved in writing by the Owner through the submission of AIA G 701. The Contractor may make substitutions only with the consent of the Owner, after evaluation by the Architect and in accordance with a Change Order or Construction Change Directive. The Work shall be in accordance with approved submittals except that the Contractor shall not be relieved of responsibility for deviations from requirements of the Contract Documents by the Architect's approval of Shop Drawings, Product Data, Samples or similar submittals unless the Contractor has specifically informed the Owner in writing of such deviation at the time of submittal and (1) the Architect has given written approval to the specific deviation as a minor change in the Work after the owner's approval, or (2) a Change Order or Construction Change Directive has been issued authorizing the deviation. The Contractor shall not be relieved of responsibility for errors or omissions in Shop Drawings, Product Data, Samples or similar submittals by the Architect's approval thereof. The District reserves the right to hold in reserve, 10% of the payment monies as retention for any work considered by the Canyons School District to be defective or not fully performed. Retention monies will be held in an interest bearing account. CONTRACTORS LIABILITY INSURANCE The contractor shall purchase and maintain such insurance as will protect him from claims under workmen's compensation acts and other employee benefit acts, from claims for damages because of bodily injury, including death, and from claims for damages to property which may arise out of or result from the contractor's operations under this contract, whether such operations be by himself or by any subcontractor or anyone directly or indirectly employed by any of them. This insurance shall be written for not less than any limits of liability specified as part of this contract, or required by law, whichever is greater, and shall exclude contractual liability insurance as applicable to the contractor's obligations. All bids shall be submitted via Bidsync. Bids delivered by e-mail or fax will not be considered or evaluated. TERMS AND CONDITIONS Bid Bonds: Bid Security is required in the form of a Bid bond issued from an authorized agency or a satisfactory surety company as surety, in the amount of no less than 5% of the maximum amount of the bid. Bid security shall be given as a guarantee that the bidder will execute the contract if the bid is awarded him, in conformity with the contract documents. A copy of the bid must be uploaded as part of the bidder's offering. The original must be delivered to the Canyons Purchasing Department the next business day. Cashier's checks nor certified funds are no longer acceptable for bonding by the District. The address for delivery is: Canyons Support Services Center, 9361 South 300 East, Sandy, Utah. Failure to deliver the original by 5:00 pm will be considered grounds for disqualification. Performance and Payment Bonds: contractors providing services for the Canyons School District, for projects of $80,000 or more, must provide a performance and payment bond prior to the commencement of the work. Claimant will be listed as Canyons School District. Costs of any bonding shall be the incurred by the Contractor. Upon receipt of notice of acceptance of the bid, the bidder agrees to execute the contract within five (5) days and deliver Performance and payment Bond in the prescribed form in the amount of one hundred percent (100%) of the general construction contract price for faithful performance of the contract and payment of sub-contractors. Contractors who are acting as subcontractors whose portion of the work is $80,000 or greater, are required to obtain a performance and payment bond naming the general contractor as claimant, prior to the commencement of the work. A copy of the bidders State of Utah contractor's license must be uploaded as part of the bidder's offering. Any early payment discounts offered to the Canyons School District are encouraged. Discounts shown may be evaluated as part of the bid award. Discounts offered for fewer than 10 working days will not be acceptable. The district reserves the right to make an award based on the grand total or per sub- total. The Board of Education reserves the right to reject any or all proposals and to waive any informality or technicality in any proposal in the best interest of the District. The project may or may not be purchased according to district budget. Should a bidder find any ambiguity, inconsistency or error in the contract documents or should bidder be in doubt as to their meaning, bidder shall at once notify the owner. Clarifications will be issued to all bidders of record. Owner will not be responsible for any oral instructions or clarifications. Should a conflict occur between the drawings and specifications and no interpretation is requested, prior to the proposal due date, the bidder will be deemed to have estimated and included in its proposal the more expensive method of doing the work. GENERAL INSTRUCTIONS Bidders: Do NOT leave a line item empty. Failure to price even one line item may result in declaring a bid as incomplete and therefore non-responsive. Bidders must submit an offering just as the bid has asked for it. Do not modify or change the bid's intent. Do not assume. Assumptions may result in disqualification. No other Canyons School District employee, Board Member, or evaluation committee member should be contacted concerning this bid during the selection process. Failure to comply with this requirement may result in disqualification. All inquiries relative to this bid must be submitted through www.bidsync.comWhen the award is made, it will be posted on www.bidsync.com.The score sheets will also be posted to our Canyons School District Purchasing Web site. In the event that the bid is canceled after the closing date, that information will be to our Canyons School District Purchasing Web site as well. TAX EXEMPT FORMS The Canyons School District will take advantage of the tax-exempt law that became effective January 1, 1996. The vendors must use tax exempt form TC721G when purchasing construction materials for Canyons School District projects. CONTRACTOR The contractor shall supervise and direct the work, using his best skill and attention. The contractor shall be solely responsible for all construction means, methods, techniques, sequences and procedures and for coordinating all portions of the work under the contract. Unless otherwise specifically noted, the contractor shall provide and pay for all labor, materials, equipment, tools, construction, equipment and machinery, water, heat, utilities, transportation, and other facilities and services necessary for the proper execution and completion of the work. The contractor shall at all times enforce strict discipline and good order among his employees, and shall not employ any unfit person or anyone not skilled in the task assigned to him. The contractor warrants to the owner and the architect that all materials and equipment incorporated in the work will be new unless otherwise specified, and that all work will be of good quality, free from faults and defects and in conformance with the bid documents. All work not conforming to these standards may be considered defective. The contractor shall be responsible for the acts and omissions of all his employees and all Subcontractors, their agents and employees and all other persons performing any of the work under a contract with the contractor. The contractor at all times shall keep the premises free from accumulation of waste materials or rubbish caused by his operations. At the completion of the work he shall remove all his waste materials and rubbish from and about the project as well as his tools, construction equipment, machinery and surplus materials, and shall clean all glass surfaces and shall leave the work clean and free from any and all debris, unless otherwise specified. The contractor shall indemnify and hold harmless the owner and their agents and employees from and against all claims, damages, losses and expenses including attorney's fees arising out of or resulting from the performance of the work. Bidders understand and agree that the bid being offered is in compliance with all State and Local codes, laws, State construction means and methods, having examined the Drawings and Specifications and related documents and the site of the proposed work and being familiar with all of the conditions surrounding the construction of the proposed project, including the availability of labor and material, hereby propose to furnish all labor, materials and supplies as required for the Project in accordance with the Contract Documents as specified and within the time set forth and at the price stated below. This price is to cover all expenses incurred in performing the work required under the Contract Documents of which this bid is a part. It is agreed by the parties to the contract that if the contractor shall fail to complete his work on or before the date set for substantial completion, or extension thereof granted by the owner, damage will be sustained by the owner and that it is, and will be, impracticable and extremely difficult to fix the actual damage with the owner will sustain in the event of and by reason of such delays. It is, therefore, agreed that the contractor will pay the owner liquidated damages in the sum of $250.00 per calendar day, for each day the contractor shall be in default. The contractor agrees that any sums which: may be due the owner as liquidated damages, may be deducted from any monies due, or that become due, the contractor under the contract of may be collected from the contractor 's surety.
