Site work and new construction of a stadium in Mason City, Iowa. Completed plans call for the construction of a stadium.
Prior thereto, at said time specified above, in the Mason City Room at the Mason City Public Library, a hearing will be held on the proposed plans, specifications, form of contract, and estimate of cost for said Improvements, and at said hearing any interested person may appear and file objections thereto. Upon registration with Submittal Exchange all bidders acknowledge receipt and responsibility ofunderstanding all construction documents to prepare their bids. Each bid must deposit bid security with the bid. The bid security must be in a sum equal to five percent of the full amount ofthe bid and must be in the form of a cashier's check or certified check drawn on a state-chartered or federally chartered bank or a certified, state draft drawn on a state-chartered or federally chartered credit union or the governmental entity may provide for a bidder's bond with corporate surety satisfactory to the governmental entity. The bidder's bond must contain no conditions. A bidder's bond must be executed by the bidder as principal and by a surety, conditioned that ifthe principals bid is accepted and the contract awarded to the principal, the principal, within ten days after notice ofthe award, shall execute a contract, or accept and return the award letter, in accordance with the terms ofthe bid, the bid bond, and any condition ofthe governingbody. The bid security shall be made payable to the City Clerk ofthe City ofMason City, Iowa. Sales Tax Exemption. Contractors and subcontractors shall not include sales tax for material purchases. At the time ofthe contract acceptance by the City Council, the prime contractor and all subcontractors will be issued a certificate of exemption. Bids shall comply with Chapter 26 ofthe Code ofIowa "Public Construction Bidding" shall govern submittal, opening and award ofbids, as amended. If a successful bidder does not execute a contract within the time allowed, the bidder's bond shall be forfeited to the governing body and the project awarded to the next lowest responsible bidder. No bidder may withdraw this bid within thirty (30) days after the actual date ofthe opening thereof. The Bid Bond ofthe three lowest Bidders for each contract will be retained until the contract has been awarded and executed, but no longer than thirty (30) days after the date ofthe Bid. By virtue ofstatutory authority, a preference will be given to products and provisions grown and produced within the State ofIowa and to Iowa domestic labor. In accordance with Iowa statutes, a resident bidder shall be allowed a preference as against a nonresident bidder from a state or foreign country ifthat state or foreign country gives or requires any preference to bidders from that state or foreign country, including but not limited to any preference to bidders, the imposition of any type oflabor force preference, or any other form ofpreferential treatment to bidders or laborers from that state or foreign country. The preference shall be equal to the preference given or required by the state or foreign country in which the nonresident bidder is a resident. In the instance of a resident labor force preference, a nonresident bidder shall apply the same resident labor force preference to a public improvement in this state as would be required in the construction of a public improvement by the state or foreign country in which the nonresident bidder is a resident. Bidders will be required to complete a Bidder Status Form from the Iowa Department ofLabor regarding the Contractor's resident status within the State ofIowa. Failure to submit a fully completed Bidder Status Form with the bid may result in the bid being deemed nonresponsive and rejected. Bids shall be in accordance with and submitted on the Bid form supplied within the Bid Documents. Failure to do so may result in rejection ofthe Bid. The Owner reserves the right to reject any and all bids and to waive any irregularities therein, and rebid the project until a satisfactory bid is received. The owner reserves the right to award to the lowest responsible bidder as may be determined by the owner. The successful bidder will be required to furnish a bond in an amount equal to one hundred (100) percent ofthe contract price, said bond to be issued by a responsible surety approved by the Owner and which shall guarantee a faithful performance ofthe Contract and the terms and conditions therein contained and shall guarantee the prompt payment of all materials and labor and protect and save harmless the Owner from claims and damages of any kind caused by the operations ofthe Contractor and shall also guarantee the maintenance ofthe improvements constructed for a period oftwo (2) year(s) after completion and acceptance by the Owner. The work ofthis Project shall be phased as defined on the Drawings and Project Manual. Occupancy and life safety systems shall be maintained during construction.
