Domestic steel use requirements as specified in Section 153.011 of the Ohio Revised Code apply to this Project. Copies of Section 153.011 of the Ohio Revised Code can be obtained from the Ohio Department of Administrative Services Disadvantaged Business (DBE) Requirement. It is the policy of the Ohio Department of Transportation that Disadvantaged Business Enterprises (DBEs) shall have equal opportunity to compete for and perform subcontracts which the Contractor enters into pursuant to this contract. The Contractor must use its best efforts to solicit bids from and to utilize DBE subcontractors with meaningful minority groups and female representation among their employees. Consequently, the requirements of Title 49 CFR Part 26 and Ohio Revised Code 5525.011 apply to this contract. The Contractor must ensure that the DBE subcontractor(s) is performing a "commercially useful function" as defined in CFR 26.55. Bidders must be prequalified with the Ohio Department of Transportation. Bidders must apply for prequalification with the department at least 30 days (for joint ventures, 5 days if both are currently pre-qualified) before the date set to open bids. For Joint Venture bidding please see Rule VII of Rules and Regulations for Qualifications of Bidders. Information pertaining to prequalification may be obtained from the Office of Contracts, Contractors Qualifications Section, First Floor, Department of Transportation Building, Columbus, Ohio telephone number (614)466-2823. Bidders must possess a valid Certificate of Qualification, as defined in Section 5523.03 of the Ohio Revised Code, at the time the bid is submitted for this project. The bidder should provide a copy of the valid certificate with the bid submittal. Two or more persons, partnerships or corporations may bid jointly on any one project, but only on condition that prior to the time bids are taken on the project the bidders make a joint application for qualification and obtain a joint Certificate of Qualification. Except as provided in Section 102.07 of the CMS, each bid must be accompanied by a certified check in the sum of 5% of bids on a solvent bank, or a bid bond in like amount, acceptable to the City of Akron, as a guarantee, that if the bid is accepted, a contract will be entered into. Bids may be held by the City of Akron for a period not to exceed 90 days from the date of the opening of Bids for the purpose of reviewing the Bids and investigating the qualifications of Bidders, prior to awarding the contract. Except as provided in Section 103.05 of the CMS, and as required by the Ohio Department of Transportation, the bidder to whom the contract is awarded will be required to furnish a bond in the sum of 100% of contract price for the faithful performance of the contract. The Director of Public Service reserves the right to reject any or all bids, and to waive informalities. Bidders must use the prepared forms provided therefore which include compliance with Section 34.03 of the Codified Ordinances of the City of Akron, Ohio regarding public contracts. Additionally, contractor compliance with the equal employment opportunity requirements of Ohio Administrative Code Chapter 123, the Governor's Executive Order of 1972, and Governor's Executive Order 84-9 shall be required
