Site work and paving for a mixed-use development in Le Mars, Iowa. Completed plans call for site work for a sidewalk / parking lot; for paving for a sidewalk / parking lot; and water / sewer project.

Proposals will be considered by representatives of said City at a meeting to be held at the Municipal Building, LeMars, Iowa, on the day and hour above specified. At 12:00 o'clock P.M. on the 6th day of August, 2019, at said place, the proposals will be considered by the City Council of said City. The extent of the work involved for 2019 PROSPECT STREET S.W. STORM SEWER consist of the following approximate quantities: Section I - Earthwork 1. Excavation (includes hauling, placing & compacting in fill areas) 750 CY Section II - Sanitary Sewer 2. Raise 48" R.C.P. Manhole 1 EA Section III - Storm Sewer 1. 48" R.C.P., Class III 1083 LF 2. 48" R.C.P. 45 Bend, Class III 4 EA 3. 48" R.C.P. 22.5 Bend, Class III 1 EA 4. 48" R.C.P. 11.25 Bend, Class III 1 EA 5. 15" R.C.P., Class III 55 LF 6. SW-509 Inlet 2 EA 7. Connection Structure RCB to Twin 48" 1 EA 8. 58" x 36" Arch R.C.P., Class III 180 LF 9. 58" x 36" to 48" R.C.P Transition 4 EA Section IV - Paving 1. 8" PCC Pavement, M-4 Concrete 52 SY 31' B-B w/Integral Curb All work and equipment is to be in accordance with the approved Plans, Specifications and form of Contract prepared by the Engineering firm of Schlotfeldt Engineering Inc., 650 12th St. S.W., LeMars, Iowa, which have been heretofore approved by the City Council and are now on file in the Municipal Building in said City of LeMars, Iowa, for public examination, and by this reference made a part hereof as though fully set out and incorporated herein. Each Proposal shall be made on the Proposal form furnished by Schlotfeldt Engineering, Inc. of LeMars, Iowa, Engineers for said City, and must be enclosed in a separate sealed envelope and plainly identified. Each proposal shall be accompanied by a bid bond, certified check, cashier's check, or credit union certified share draft in a separate sealed envelope in an amount equal to five percent (5%) of the total amount of the bid. If a bid bond is submitted, IT SHALL BE ON THE BID BOND FORM FURNISHED BY THE ENGINEER. The certified check or cashier's check shall be drawn on a bank in Iowa or a bank chartered under the laws of the United States of America; the certified share draft shall be drawn on a credit union in Iowa or a credit union chartered under the laws of the United States; and such check or draft shall be made payable to the Treasurer of the City as security that if awarded a Contract, the Bidder shall enter into a Contract at the prices bid and furnish the required performance and Payment Bonds and Certificate of Insurance. The certified check or cashier's check or certified share draft may be cashed, or the bid bond forfeited, and the proceeds retained as liquidated damages if the bidder fails to execute a Contract or file acceptable Performance and Payment Bonds or provide an acceptable Certificate of Insurance within ten (10) days after the acceptance of his bid Proposal by resolution of the Council. No bidder shall be allowed to withdraw a bid Proposal within thirty (30) days after the date set for opening bids. By virtue of statutory authority, preference will be given to products and provisions grown and coal produced within the State of Iowa, and to Iowa domestic labor, to the extent lawfully required under Iowa statutes; provided that the award of Contract will be made to the lowest responsible bidder submitting the lowest responsible bid, which shall be determined without regard to state or local law whereby preference is given on factors other than the amount of bid. The City reserves the right to reject any or all Proposals, re-advertise for new bids, and to waive informalities that may be in the best interest of the City. The successful bidder shall be required to furnish a "Performance Bond" in an amount equal to one hundred percent (100%) of it's Contract price, said bond to be issued by a responsible surety approved by the City Council and shall guarantee the faithful performance of the Contract and the terms and conditions therein contained and the maintenance of said Improvements for the City as required by the Specifications. The successful bidder shall be required to furnish a "Payment Bond" in an amount equal to one hundred percent (100%) of the Contract price, said bond to be issued by a responsible surety approved by the City Council and shall guarantee the prompt payment, as required by the law, of all persons supplying labor and materials in the execution ofthe work provided for in the Contract. Payment to the contractor shall be made by the City in cash from such funds as are legally available. Monthly payments shall be paid the Contractor in an amount equal to ninety-five percent (95%) of the Contract value of the work completed and approved by the Engineer. The final five percent (5%) shall be released thirty-one (31) days after the City Council accepts the work and approves the Final Pay Request if all contractual obligations have been completed by the Contractor. Provisions may be made by the City Council to withhold larger amounts than the five percent (5%) stated above where there is specific necessity and right to do so. The City of LeMars, Iowa is registered with the Iowa Department of Revenue and Finance as a sales and use tax exempt entity. The City of LeMars has elected to issue an authorization letter and exemption certificate to Contractors which allows purchase of qualifying items to be made exempt from Iowa Sales Tax, Local Option Sales Tax and School Infrastructure Local Option Sales Tax. Qualifying exempt items can be found on the Iowa Department of Revenue and Finance electronically. The work listed shall be commenced on or before the date specified by a written Notice to Proceed from the City and shall be completed no later than September 24th, 2019. Bidder shall also agree to pay as liquidated damages, the sum of One Hundred Fifty Dollars ($150.00) for each "per calendar day" thereafter as provided in the Specifications for substantial completion of improvements. Bidders must bid on all items and sections as set out in the Proposal form. The City Council will award a single Contract to the lowest responsible bidder.
