The Cone of Silence begins on the day the bid is advertised and terminates when the contract is awarded by the Owner. The Owner reserves the right to accept or reject any or all proposals and to waive formalities. Also, the Owner reserves the right to accept the offerors proposal based on the tabulation of any one, combination or all of the base bid(s), alternate bid(s) and/or, optional bid(s) based on the most advantageous project proposal that is desired by the Owner. Please note the Owners experience requirements, for award of this project, in Section I-B, Information for Bidders, item No. 6, Method of Award-Lowest Responsible and Responsive Bidder: The successful bidder must furnish a performance and payment bond as required by law, and the terms of this contract. Federal Funds are anticipated to be used in this project and the Davis-Bacon Act, Section 3 of the Housing and Urban Development Act of 1968, and Executive Order 11246, will apply. In the event that federal funds are not disbursed to the Owner for this project, or that federal funds disbursed are insufficient to proceed with this Project, as determined by the Owner, the Owner shall have no further legal obligations in connection with this project without any legal obligation for compensation or damages to the bidder. The contractor shall pay not less than the wage rate as determined by the Department of Labor, Wage and Hour Division. It is the bidder's responsibility to ensure that they have all pertinent information regarding solicitations, including all amendments prior to submitting their offer.
