All proposals shall be accompanied by a bidder bond or a cashiers check drawn upon a national or state bank in the amount of 5% of the total amount bid payable to Cypress Creek Utility District as guarantee that the bidder will enter into a contract and execute a performance bond within ten (10) days after notice of the award, and that his bid will not be with- drawn within sixty (60) days after the date of opening of bids without the consent of OWNER. Bids not accompanied by a bidders bond or a cashiers check will not be considered. The right is reserved, as the interest of the OWNER may require, to reject any and/or all bids, and to waive any informality in bids received. This contract is contingent upon release of funds from the Texas Water Development Board (TWDB). Any contract or contracts awarded under this Invitation for Bids are expected to be funded in part by a loan from the Texas Water Development Board, and shall be referred to as Project No. 73770. Neither the State of Texas nor any of its departments, agencies, or employees is or will be a party to this Invitation for Bids or any resulting contract.
