This Project includes, but is not limited to, design, replacement, and rehabilitation of the existing sewer collection system including lining of 8,050 linear feet of sewer main and replacement of 4,780 linear feet of sewer main identified to address structural pipe failures and reduce infiltration and inflow sources to the collection system; and all materials and equipment, services and construction inherent to the Work. The Project being bid is subject to Massachusetts General Laws, Chapter 30, Section 39M and prevailing wage rates as issued by the Director of the Executive Office of Labor and Workforce Development, Department of Labor Standards under the provisions of Massachusetts General Laws, Chapter 149, Sections 26 to 27D inclusive, as amended, apply to this Project. Owner reserves the right to reject any or all Bids, including without limitation, nonconforming, nonresponsive, unbalanced, or conditional Bids. Owner further reserves the right to reject the Bid of any Bidder whom it finds, after reasonable inquiry and evaluation, not to be responsible or eligible or not to meet the specified qualification or quality requirements, based on poor references or otherwise. Owner may also reject the Bid of any Bidder if Owner reasonably believes that it would not be in the best interest of the Project or the public to make an award to that Bidder. Owner also reserves the right to waive all informalities not involving price, time, or changes in the Work and to negotiate contract terms with the Successful Bidder. Disadvantaged Business Enterprise (DBE) goals are not applicable to this Project. The fair share goals for disadvantaged business enterprise (DBE) participation for this Contract are a minimum of 4.20 percent Disadvantaged Minority Business Enterprise (D/MBE) participation and 4.50 percent Disadvantaged Women Business Enterprise (D/WBE) participation, applicable to the total dollar amount paid for the construction Contract. The Contractor shall take all affirmative steps necessary to achieve this goal, and shall provide reports documenting the portion of Contract and subcontract dollars paid to DBEs, and its efforts to achieve the goals, with each invoice submitted or at such greater intervals as specified by the Owner. The Contractor shall require similar reports from its Subcontractors.
