Bid preparation will be in accordance with the Information for Bidders section bound in the Project Manual. Ellisville State School reserves the right to waive irregularities and to reject any or all bids. Ellisville State School is an equal opportunity employer/MFHV. An independent testing laboratory will sample and test materials that are components of the final work product of the Contractor and provide certification that the materials meet the required specifications. The laboratory shall oversee the certification process of construction personnel to ensure their qualifications to perform the specified duties. The presence of a testing laboratory shall in no way relieve the Contractor of his obligation to perform the work in accordance with the Contract Documents. The contractor shall be responsible for paying the testing laboratory for these services. The OWNER reserves the right to reject the Proposal or to waive any informality or technicality in the Proposal in the interest of the OWNER. The Bidder may not withdraw his Proposal for a period of ninety (90) days after the date of submission. A Bid Bond or Certified Check in the amount of five percent (5%) of the amount of the Bid, will be required for this contract. The successful Bidder, simultaneously with the execution of the Contract, will be required to furnish a Performance and Payment Bond in the amount equal to 100 percent of the Contract amount. The Bond shall be secured from a Surety Company satisfactory to the OWNER. The form of the Bond of the successful Bidder will be required to be executed and included in the Contract Documents
