Bids must be submitted on the Bid Forms provided in the bound Bidding DocumentsPackage and be accompanied by the bidder's certified check or bid bond in the amount of five percent (5%) of the total bid. A performance bond will be required of the successful bidder. The successful bidder will also be required to obtain a contractor'slicense and submit a certificate of insurance for workers' compensation. The prevailing hourly rate of wages, as determined by the Federal Wage Determination and/or the IndustrialCommission of Missouri, Annual Wage Order #26, including amendments, will be complied with on this project, and notlessthanthe prevailing hourly rate of wages as found by the agencies or Court of Appeals shall be paid to all workmen performing work under this contract. No bidder may withdraw his bid within 60 days after the actual date of the opening thereof. Bidders are informed that pursuant to Section 285.530, RSMo, as a condition of the award of any contract in excess of five thousand dollars ($5,000.00), the successful bidder shall, by sworn affidavit and provision of documentation, affirm its enrollment and participation in a federal work authorization program with respect to the employees working in connection to the contracted services. Successful bidders shall also sign an affidavit affirming that it does not knowingly employ any person who is an unauthorized alien in connection to the contracted services. The City reservesthe rightto reject any and all bids, to waive informalities or irregularities, and to determine the lowest responsive and responsible bidder, and to award the contract on that basis. All Bidders must agree that such rejection shall be withoutliability on the part ofthe City for any damage or claimbrought by anyBidder because ofsuchrejection, nor shall the Bidder seek any recourse of any kind against the City because of such rejection. The filing of any Bid in response to this invitation shall constitute an agreement of the Bidder to theseconditions.
