Site work and renovation of a water / sewer project in Oceanside, California. Completed plans call for site work for a water / sewer project.

The general items of work included in the scope of work are as follows: Remove existing 6" waterline and replace with separate 6" firewater line and 3" domestic water line. Provide existing valve vault modifications and new backflow assemblies. Provide general structural repairs. Remove electrical facilities and install new electrical facilities. Additive alternate item: Remove and replace existing pier railing . A bid shall not be considered by the Agency unless a bidder's security in an amount equal to at least ten percent (10%) of the amount bid is enclosed with it in the sealed envelope. The bidder's security shall be in one of the following forms . Cashiers check made payable to the Agency . A certified check made payable to the Agency . Performance Bond for one hundred percent (100%) of the contract award to guarantee faithful and timely performance of all work, in a manner satisfactory to the AGENCY, and further guarantee that all materials and workmanship will be free from original or developed defects. b. "Payment Bond" (material and labor bond) for one hundred percent (100%) of the contract award to satisfy claims of material suppliers, mechanics, and laborers employed by Bidder on the Work that is the subject of the agreement. Time is of the essence in the performance of work under this contract. All work shall be completed in every detail to the satisfaction of the Engineer, exclusive of Maintenance Periods, within 210 working days after the commencement date set forth in the Notice to Proceed. The Agency Reserves the Right to Reject Any or All Bids and to Waive Any Irregularity Except That the Agency Shall Not Re-compute, Adjust or Modify the Total Amount Bid Submitted by Any Bidder. The Agency Reserves the Right to Adjust Any Lump Sum or Unit Price Item if the Total Bid Amount Does Not Reflect the Added Value of the Individual Bid Item The Liquidated Damages for failure of the Contractor to complete the work within the Contract Time set forth in Subsection 1.3.4 and Section 6, Notice to Proceed are in the sum of twenty-five hundred dollars ($2500) per consecutive day in excess of the contract time. Pursuant to Government Code Section 4215, the Agency Shall Assume Responsibility For the Cost of the Timely Removal, Relocation, or Protection of Existing Main or Trunkline Utility Facilities Located on the Construction Site Subject to This Contract, if Such Utilities Are Not Identified by the Agency in the Plans and Specifications Made a Part of the Contract Documents. The Contractor Shall Be Compensated, in Accordance With Subsection 7.21, for the Costs of Locating and Repairing Damage Not Due to the Failure of The Contractor to Exercise Reasonable Care, and Removing or Relocating Such Utility Facilities Not Indicated in the Contract Documents With Reasonable Accuracy, and for Equipment on the Project Necessarily Idled During Such Work. The Contractor Shall Not Be Assessed Liquidated Damages for Delay in Completion of the Project, When Such Delay Was Caused by the Failure of the Agency or the Owner of the Utility to Provide for Removal or Relocation of Such Utility Facilities . No Progress Payment Made to the Contractor or Its Sureties Will Constitute an Acceptance of the Work, a Waiver of the Liquidated Damages or a Waiver of Any Other Remedies Available at Law Execution of the Contract Shall Constitute Agreement by the Agency and Contractor That Twenty-five Hundred Dollars ($2,500.00) Per Day is the Reasonable Estimate of the Value of the Costs and Actual Damage Caused by Failure of the Contractor to Complete the Work Within the Allotted Contract Time, That Such Sum Is Liquidated Damages and Shall Not Be Construed as a Penalty, and That Such Sum May Be Deducted From Payments Due the Contractor if Such Delay Occurs.
