The Governor of the State of Oklahoma, on March 15, 2020, declared a state-wide emergency due to the impending threat of COVID-19. Gatherings and events of more than 10 people are discouraged and, in some localities, prohibited. Section 110 of the Public Competitive Bidding Act requires that the Bid Opening be open to the public and to bidders. In order to satisfy the requirements of this Act and be responsive to the Governors emergency declaration, members of the public and prospective bidders are encouraged, but not required, to refrain from in person attendance and to view the bid opening through remote videoconferencing. Those bidders who do not wish to attend the bid opening may contact Noelle Hayes at 918-341-1325 ext 134 or nhayes@claremorecity.com for information regarding the ability to remotely attend the bid opening via videoconference. The project includes but is not limited to the replacement of a wind cone and installation of perimeter fencing as shown on the plans and indicated in the specifications. The major items of work include: Removal and replacement of the existing wind cone. Remove the existing entrance gate and install a new 25 inch automatic sliding cantilever gate and operator system. Remove 4,000 LF of existing barbed wire and 4 inch chain-link fence Install 7,000 LF of 8 inch chain-link fence with 3-strand barbed wire. Install 4 manual double swing gates Install pipe frame channel crossing. 1 acre of tree/brush clearing. Bidders must enter the addenda numbers in the Proposal to verify receipt. Proposals shall be accompanied by a cashiers or certified check upon a national or state bank in an amount not less than five percent (5%) of the total maximum bid price payable without recourse to the Owner, or a bid bond in the same amount from a reliable surety company, as a guarantee that the Bidder will enter into a contract and execute performance and payment bonds within ten (10) days after notice of award of Contract to him. Such bid guarantee shall be made payable to Owner. The successful bidder must furnish a performance and payment bond upon the form provided in the amount of one hundred per cent (100%) of the contract price from an approved surety company holding a permit from the State of Oklahoma to act as surety, or other surety or sureties acceptable to the Owner. Certain mandatory federal requirements apply to this solicitation and will be made a part of any contract awarded: 1. Buy American Preferences (Title 49 U.S.C. Chapter 501) 2. Foreign Trade Restrictions (49 CFR 30.17) 3. Davis Bacon Labor Provisions (29 CFR Parts 1, 3, and 5) 4. Requirement for Affirmative Action (41 CFR Part 60-4) 5. Debarment, Suspension, Ineligibility, and Voluntary Exclusion 6. Requirements for Drug-free Workplace Davis Bacon Act wage rules shall apply. All laborers and mechanics employed by contractors and subcontractors on projects funded directly by or assisted in whole or in part by and through the Federal Government shall be paid wages at rates not less than those prevailing on projects of a character similar in the locality as determined by the Secretary of Labor in accordance with subchapter IV of Chapter 31 of Title 40, United States Code. The Department of Labor provides all pertinent information related to compliance with labor standards, including prevailing wage rates and instructions for reporting. All bidders and proposers shall make good faith efforts, as defined by Appendix A of 49 CFR Part 26, Regulations of the Office of the Secretary of Transportation, to subcontract a minimum of seven point one-seven (7.17%) percent of the dollar value of the prime contract to small business concerns owned and controlled by socially and economically disadvantaged individuals (DBE). The City of Claremore reserves the right to reject any or all bids, to waive irregularities in the bids and bidding deemed to be in the best interests of the City of Claremore, and to reject nonconforming, nonresponsive, or conditional bids. Bids must remain in effect for 90 days after the bid opening date. Goals for minority participation for each trade: 10.2% Goals for female participation in each trade: 6.9%
