All DRAWINGS, SPECIFICATIONS, and SUBMITTALS required pursuant to section 3.14, and any other document or submission required under this Agreement or prepared at any time in connection with the Project, whether in written or electronic form, are and shall remain the OWNER's sole property. The OWNER's interest in and right to any documents shall not be conditioned upon payment of all or any portion of the Contract price. These documents shall not be reproduced or used by the CONTRACTOR for any purpose except as (a) required for the performance of the services under this Agreement, or (b) as specifically authorized by the OWNER. Simultaneously with the delivery of the executed Contract by the Contractor, the Contractor shall furnish a Performance and Payment surety bond in the amount of 100% of the Contract Sum - as security for faithful performance of the Contract and for the payment of all persons performing labor and furnishing materials for the work, or pursuant to Institution Requirements, evidence of eligibility for waiver of the bond requirements. The surety on such bond shall be a surety company duly authorized to do business in the state of Iowa.
