The Tin Pan Gob Reclamation Project involves stabilization of steep slopes on two coal gob piles approximately two acres in size that have been contributing mine waste to an adjacent ephemeral channel. Work includes establishment of vegetation and installation of various erosion control structures necessary to facilitate effective stormwater management. A hundred percent (100%) Performance Bond and a one hundred percent (100%) Payment and Materials Bond for the total contract amount, including appropriate New Mexico Gross Receipts Tax, executed by a surety company authorized to do business in the state of New Mexico shall be required from the successful Bidder prior to award of contract. A subcontractor shall provide performance and payment bonds if the subcontractor's contract (to the Contractor) for work to be performed is one hundred twenty-five thousand dollars ($125,000) or more. Failure of a subcontractor to provide the required bonds shall not subject owner to any increase in cost due to approved substitution of subcontractor. The Work to be performed under this Agreement shall commence no later than ten (10) consecutive calendar days after the date of written "Notice to Proceed." Project completion shall be no later than two hundred forty (240) days, including all Sundays, holidays, and non-work days, after the Contractor receives a written Notice to Proceed, except as hereafter extended by EMNRD by valid written Change Order.
