Site work and paving for a civil project in Newburgh, New York. Completed plans call for site work for a bridge / tunnel; road / highway; and for paving for a road / highway.
**As of September 10, 2020, the project has not been awarded. A timeline for the award is not yet determined.** The Owner is the Town of Newburgh and the work site is located on Gardnertown Road, from Creek Run Road to Gidney Avenue. The work includes providing all labor, materials, machinery, tools, equipment and other means of construction necessary and incidental to the completion the work shown on the plans and described in these specifications including, but not necessarily limited to the following: Complete removal and replacement of the existing culvert (BIN 3360190). Total replacement of the existing guiderail, while maintaining the existing highway section that exists near culvert today, curb reconstruction and signing and pavement striping. This is a Federal Aid Project and NYSDOT Standard Specifications, officially finalized and adopted on May 1, 2020 as posted on the New York State Department of Transportation website must be followed by the successful bidder. The work will be substantially completed on or before the date identified as 180 calendar days from the date the Notice to Proceed is issued, completed and ready for final payment on the date identified as 210 calendar days from the Notice Proceed is issued. This project is a Prevailing Wage Project. The DBE goal for this project is 8%. The EEO employment goals for this project are a 17.0% minority employment goal and 6.9% women employment goal. The use of the NYSDOT approved civil rights reporting software, Equitable Business Opportunities (EBO), is required. No residential or geographical restrictions will be in effect for this project. Federal requirements will take precedent over State and local requirements, unless state and local requirements are deemed to be more stringent. Contractors that obtain Contract Documents from a source other than the Issuing Office must notify CHA in order to be placed on the official Plan Holders List, to receive Addenda and other Bid correspondence. Bids received from Contractors other than those on the official Plan Holders list will not be accepted. Addenda will be emailed from CHA to Bidders listed on the official Plan Holders List. An emailed response from the Bidder, to the Addenda sent by CHA will act as proof the Bidder received the Addenda. In addition to an emailed response, Bidders must acknowledge the receipt of all Addenda by signing and dating each Addendum in section 3a of the bid form. Failure of any Bidder to receive any such Addendum or interpretation shall not relieve such Bidder from any obligation under this Bid submittal. All Addenda so issued shall become part of the Contract Documents. The Bidder shall promptly notify CHA of all conflicts, errors, ambiguities or discrepancies found within the Contract Documents. All bids must be made on the official Bid Form and Bid Summary Form or an exact copy by reproduction thereof and enclosed in a sealed envelope. All bidders are required to submit complete Non-Collusive Bidding and Debarment Certification and Lobbying Certifications. This is a unit price bid as described in the Instructions to Bidders. No Bidder may withdraw his bid within forty-five calendar days after the actual date of the opening thereof. Each bid must be accompanied by a bid security in the amount of five percent of the base bid in accordance with the Instructions to Bidders. At the time of execution of the Contract, the Contractor shall furnish the Owner the necessary bonds approved by the Town Attorney as to form and sufficiency. The required bonds shall be substantially conditioned to provide that the Contractor shall faithfully perform the Contract on his part, and shall satisfy all claims and demands incurred for the same, and shall indemnify the Town against any and all claims for damage on account of work performed under the Contract. The Contractor shall procure and maintain, at his expense, until final acceptance by the Owner of the work covered by the Contract, liability insurance for Workmen's Compensation and for bodily injury and property damage, and said insurance shall be kept in full force and effect by the Contractor by payment of the required premiums during the term of the work performed under the Contract. Pursuant to General Municipal Law 108, the bidder stipulates and agrees that any agreement shall be void and of no force or effect unless the person, entity or corporation making or performing such agreement secure compensation for the benefit of, and keeps insured during the life of such agreement its employees, in compliance with the Workers' Compensation Law. The Contractor shall furnish promptly upon demand by the Owner proof that said insurance remains in full force and effect. The Contractor's failure to procure or maintain said insurance shall constitute an act of default and entitle the Owner to terminate the Contract (as set forth in General Conditions, Article XIII) or, at the Owner's sole discretion, shall entitle the Owner to procure and maintain such insurance on behalf of the Contractor and at the Contractor's sole expense, and to charge the costs of all premiums against the Contractor's payment requisitions for the period in question. The successful Bidder will be required to furnish construction performance and payment bonds in the full amount of the contract price, insurance certificate(s) and execute contract with owner. The successful Bidder and all subcontractors must have a CCA-2 on file with NYSDOT prior to being awarded a contract. If the successful Bidder does not currently have a CCA-2 on file with NYSDOT, the Bidder may find the CCA-2 forms and instructions for completion online The successful bidder will be required to comply with all provisions of the Federal Government Equal Employment Opportunity clauses issued by the Secretary of Labor on May 21, 1968 and published in the Federal Register (41CFR Part 60-1, 33 F.2 7804). Owner reserves the right to reject any and all Bids, to waive any and all informalities and the right to disregard all nonconforming, non-responsive or Conditional Bids. Pursuant to General Municipal Law 108, the bidder stipulates and agrees that any agreement shall be void and of no force or effect unless the person, entity or corporation making or performing such agreement secure compensation for the benefit of, and keeps insured during the life of such agreement its employees, in compliance with the Workers' Compensation Law. Each bid must contain the Certificate of Compliance with General Municipal Law Sections 103-a and 103-b.
