Small Business Prime - Yes In the event of a conflict between LACMTA's living wage (see Special Provision titled Living Wage/Service Contract Worker Retention Policy), the prevailing wage under state law as determined by California
authorities, and the prevailing wage under federal law as determined by the U.S. Department of Labor, the Contractor shall pay at minimum the highest of the three (3) wages. If an SBE business is a supplier providing materials/supplies, only sixty-percent (60%) of the cost will be credited toward the SBE goal. LACMTA will take 60% of the cost for materials/supplies listed in Column E to credit for SBE participation. If an SBE supplier, please list 60% of the Bid/Proposal Price in Column F. Disabled Veteran: A veteran of the United States military, naval or air service; who has service connected disability of at least 10% or more; and the veteran must reside in California. The definition will always defer to the latest California Military and Veterans Code. Business must be at least 51% owned by one or more disabled veterans. Contractor shall complete all Services under the Contract no later than Monday, June 1, 2026 (Contract Completion Date). If the Contract represents more than fifty (50%) percent of the Contractor's business (% defined as direct labor v. total Contractor direct labor), outside professional expenses incurred in preparing and negotiating Contractor's positions on claims, disputes, or audits related to issues of reasonableness, allowability, or allocability shall not be allowable as a direct or indirect cost to LACMTA, unless prior written approval is obtained from LACMTA.
