The Contractor Shall Pay the City as Liquidated Damages, the Amount of $800.00 a Day for Each Calendar Day the Project is Delayed Beyond the "time of Completion Date". The City will withhold five percent (5%) retention from payments due the Contractor until thirty-five (35) days after date of recording of the Notice of Completion. The Contractor may elect to receive one hundred percent (100%) of payments due under the contract by depositing securities of equivalent value with the City in accordance with the provisions of the California Civil Code Section 9550, et seq. The right is reserved by the City of Lindsay to reject any or all bids, to evaluate the bids submitted and to award the contract according to the proposal which best serves the interests of said City. Prevailing Wages: This is a public works project and therefore subject to registration with the California Department of Industrial Relations (DIR), payment of State prevailing wages and electronic certified payroll submission to the Labor Commissioner.
