Widen SR 1521 (Lake Pine Drive) from east of Pine Plaza Drive/MacGregor Pines Drive to the Apex Town limit north of Versailles Drive from 2-lanes to 3-lanes, construct sidewalks located on Lake Pine Drive, construct a 10-foot street-side trail on the east side of Lake Pine Drive, and provide a high-visibility crosswalk at Versailles Drive. Bid must be accompanied by an original, fully executed Bid Bond payable to Owner in an amount of five percent (5%) of the total amount of the bid. A certified check, in the above referenced amount, may be used in lieu of a Bid Bond. The Town reserves the right to reject any or all bids, to waive technicalities, to advertise for new bids or to proceed to do the work otherwise, if in the judgement of the Town, it is in the best interest of the Town. The successful Bidder, within ten (10) calendar days after the Notice of Award is issued, shall provide the Town of Apex with a contract payment bond and a contract performance bond each in an amount equal to 100 percent of the amount of the contract. All bonds shall be in conformance with G.S. 44A-33. The corporate surety furnishing the bonds shall be authorized to do business in the State. Failure on the part of the successful bidder to file acceptable bonds within the time specified above shall be just cause for the forfeiture of the bid bond or bid deposit and rescinding award of the contract. Award may then be made to the next lowest responsible bidder or the work may be re-advertised.
