Should the cost of these sustained damages exceed the amounts owed by the Commission, the Materialman shall pay the difference to the Commission. Each Proposal shall be accompanied by cash, cashier's check, or certified check drawn on a bank insured by the Federal Deposit Insurance Corporation or Savings Association Insurance Fund. Checks shall be made payable to the Public Works Commission of the City of Fayetteville, North Carolina, in an amount not less than five percent (5%) of the total bid as a guarantee that a Contract, if awarded, will be entered into. In lieu thereof, a Bid Bond which conforms to the provisions of G.S. 143-129 as amended by Chapter 1104 of the Public Laws of 1951 may be submitted by the Bidder.
