Site work for a water / sewer project in Desert Hot Springs, California. Completed plans call for site work for a water / sewer project.

Replace 8-inch PVC with an 8-inch ductile iron waterline, including service laterals, and waterline appurtenances within the Desert Willows Gated Community in the City of Desert Hot Springs. Bid alternate work includes asphalt pulverization and replacement of private streets within the Desert Willows Gated Community in the City of Desert Hot Springs. Additional safety precautions will be implemented as described below. COVID-19 GATHERING RESTRICTIONS: Due to ongoing gathering restriction from the State Public Health Office and the Riverside County Health Office, MSWD will be limiting gatherings to no more than 10 people in a space at any given time, regardless of venue. If a venue is subdivided into multiple spaces separated by physical walls or sufficient airspace, the limit per subdivision of space is 10 people. Observing County, State, and Federal order, MSWD has determined convening in single groups of "10", while maintaining adequate social distances, is a suitable approach for a safe Bid-Walk of the "Desert Willows Waterline Replacement Project". A Waiver and Release of Liability (ROL) sheet will distributed for all participating bidders to acknowledge and sign prior to bid-walk. Bidders will be required to have their own safety measures in place and exercise safe distance (Gloves, face mask, sanitizing lotion, etc..). Any bidder with signs of the flu or any other COVID-19 related symptoms will be restricted to participate. MSWD staff will efficiently administer each group, individually given the opportunity to fully complete a bid-walk. All questions relating to the bid- walk will be directed to , considering time restraints. To ensure the public health safety of you and the well-being of, MSWD staff, your employees the community, MSWD is exercising this order seriously PLANS AND SPECIFICATIONS All of the above work is to be done under contract with Owner in accordance with those certain plans, specifications and drawings prepared by the Owner, considered and approved by the Board of Directors of Owner and to which documents reference is hereby made for a description of said Works and Improvements. BIDS At said website, bidders may obtain copies of the plans and specifications for the contemplated improvements. BONDS The Contractor will be required to furnish with the contract a Contract Performance Bond in the amount of one hundred percent (100%) of the aggregate amount of the bid, and a Payment Bond in the amount of one hundred percent (100%) of the aggregate amount of the Bid. The Contractor will also furnish certificates of insurance evidencing all insurance coverage as required by the specifications. Contractor may, upon written request, and at his sole expense after the Board of Director's approval, deposit securities referenced in Government Code Section 16430, or bank or savings and loan certificates of deposit, as authorized by Public Code Section 22300 in lieu of retention monies withheld to ensure performance. PREVAILING WAGES NOTICE IS FURTHER GIVEN that the Board of Directors has obtained the general prevailing rate of per diem wages in accordance with law to be paid for the construction of the above entitled Works and Improvements. The prevailing wage schedules have been obtained from the Director of the Department of Industrial Relations, pursuant to the provisions of Section 1773 of the Labor Code of the State of California, and reference is hereby made to copies thereof on file in the District Office, which said copies are available to any interested party upon request. Further, a copy shall be posted at each job site during the course of construction. Also, see Section "Project Funding" on page PD-5. CONTRACTOR REGISTRATION All contractors and subcontractors submitting or included in bids for the Project shall be registered and in good standing with the California Department of Industrial Relations (DIR) in accordance with the requirements of California SB-854. No contractor or subcontractor may be listed on a bid proposal for a public works project unless registered with the DIR pursuant to Labor Code section 1725.5 [with limited exceptions from this requirement for bid purposes only under Labor Code section 1771.1(a)]. No contractor or subcontractor may be awarded a contract for public work on a public works project unless registered with the DIR pursuant to Labor Code section 1725.5. PAYMENT Payments will be made in cash by Owner to the Contractor in accordance with the provisions of the specifications and on itemized estimates duly certified and approved by the General Manager of the Owner submitted in accordance therewith, based on labor and materials incorporated into said Works and Improvements during the preceding month by the Contractor. Payment shall not be made more often than once each thirty (30) days. Final payment shall be made thirty-five (35) days subsequent to filing of the Notice of Completion. The Contractor may upon written request, and at their expense, after approval by the Owner, deposit substitute securities found in Government Code Section 16430 as authorized by the Public Contract Code Section 22300 in lieu of retention monies withheld to ensure performance. BID SECURITY All proposals or bids shall be accompanied by a cashier's or certified check, payable to the order of Owner, amounting to ten percent (10%) of the bid or by a bond in said amount and payable to Owner, signed by the bidder and a corporate surety, or by the bidder and two (2) sureties who will justify before any officer competent to administer oaths, in double said amount and over and above all statutory exemption. Said check shall be forfeited or said bond shall become payable to Owner in case the bidder depositing the same does not, within ten (10) days after written notice, sign the contract. PRESIDENT'S EXECUTIVE ORDER Bidders on this Work will be required to comply with the President's Executive Order No. 11246 (Equal Employment Opportunity Clause) as amended, California Labor Code 1410 et. seq., California Labor Code 1777.6, and implementary regulations concerning equal opportunity for Apprentices. LABOR COMPLIANCE This project is subject to the requirements of California Labor Code Section 1770 et seq. requiring the payment of prevailing wages, requiring the training of apprentices, and compliance with other applicable requirements. In accordance with provisions of Section 1773 of the Labor Code, the Director of the Department of Industrial Relations has ascertained the general prevailing rate of wages and employer payments for health and welfare, pension, vacation, and similar purposes applicable to the particular craft, classification, or type of workers employed on the work. The wage determinations shall be included in the bid specifications. All pertinent wage determinations shall be posted on the jobsite. If federal funding is included in the project, the higher of the State and Federal wage rates shall be used. In accordance with SB854, this project is subject to compliance monitoring and enforcement by the Department of Industrial Relations. In addition, pursuant to the project's Proposition 84 grant requirements, the District has instituted a Labor Compliance Program (LCP) and all contractors who perform work on projects covered by the LCP with this awarding body will be subject to the terms of that LCP. As a condition to receiving progress payments, final payment and payment of retention on any and all projects on which the payment of prevailing wages is required, the contractor agrees to present to the District, along with its request for payment, all applicable and necessary Certified Payrolls Records (CPRs) and other required documents for the time period covering such payment request. The District shall withhold any portion of a payment, including the entire payment amount, until CPR forms and other required LCP documents are properly submitted. In the event that CPR forms do not comply with the requirements of Labor Code Section 1776 et seq., or wage violations are identified by the LCP, the District may continue to hold sufficient funds to cover estimated wages and penalties under the contract. Pursuant to SB854 all public works contractors and subcontractors shall furnish electronic CPRs directly to the Labor Commissioner. The contractors and subcontractors must furnish electronic certified payroll records to the Labor Commissioner using the DIR's online portal: http://www.dir.ca.gov/Public-Works/Certified-Payroll-Reporting.html. AWARD AND EXECUTION The award of contract, if made, will be within ninety (90) calendar days from the date of the bid opening. Bidders shall agree that the Bid shall be good and may not be withdrawn for a period of ninety (90) calendar days after the date of the bid opening. The Contractor shall execute the Contract within ten (10) calendar days after he has been notified in writing of the award. The Owner hereby reserves the right to reject any and all proposals, to waive any irregularity, and to award the contract to the lowest responsive and responsible bidder. If single Contract is to be awarded for the entire Project, including the Bid Alternative, it will be awarded to the lowest responsive, responsible, and qualified Bidder whose evaluation by Owner indicates to Owner that the award will be in the best interest of the Project. The basis for award shall be the total of the Base Bid and the Bid Alternative from the Bid Schedules for the Project. If the entire Project is not awarded, it will be awarded to the lowest responsive, responsible, and qualified Bidder whose evaluation by Owner indicates to Owner that the award will be in the best interest if the Project. The basis for award shall be the subtotal of the Base Bid and the Bid Alternative selected by the Owner from the Bid Schedule. The Owner reserves the right to award or not to award the Bid Alternative in the best interest of the Owner. CONTRACTOR'S LICENSE CLASSIFICATION The prime contractor must possess a current and valid California Contractor's License for one of the following: Class A General Contractor Class C-34 Pipeline Contractor PThis project requires construction of excavations which are five (5) feet or deeper
