No phone calls will be accepted. Bids received after the deadline date and time will be rejected and returned unopened. Bids must be accompanied by a bidder's bond, cashier's check or certified check (hereinafter, the "Bid Security") for TEN PERCENT (10%) of the amount of the bid. The bidder's bond or certified check shall be made payable to the EL MONTE UNION HIGH SCHOOL DISTRICT and shall be given as a guarantee that the bidder will enter into a contract if a contract is awarded to the bidder, and will be declared forfeited, paid to, or retained by the DISTRICT as liquidated damages if the bidder refuses or neglects to enter into a contract on the terms of the accepted proposal within fourteen (14) calendar days after bidder's notification of DISTRICT's acceptance of the proposal. No bidder may withdraw any bid for a period of SIXTY (60) calendar days after the date set for the opening of bids. Prior to commencement of the Work, the Contractor shall furnish a Performance Bond as security for Contractor's faithful performance of the Contract and a Labor and Material Payment Bond as security for payment of persons or entities performing work, labor or furnishing materials in connection with Contractor's performance of the Work under the Contract Documents. Unless otherwise stated in the Special Conditions, the amounts of the Performance Bond and the Payment Bond required hereunder shall be one hundred percent (100%) of the Contract Price.
