Reference number: 1417911 The Ecole de technologie superieure tender for Pavilion F, Lot 2, Pile Levelling and Excavation, at the northern portion of William, Young, Ottawa and Murray streets in Montreal. Deadline for receipt of complaints: 2020-11-02 Electronic submissions recommended and accepted at www.seao.ca Hard copy submissions by appointment only, the campus has limited opening hours. Type of submission: Flat rate CONDITIONS Bidder must demonstrate that it has managed and completed five (5) environmental rehabilitation projects in the past five (5) years, each of which was over $1,000,000; must demonstrate that the proposed project manager and superintendent each coordinated and managed two (2) environmental rehabilitation projects over the past five (5) years, each of which was more than $1,000,000 for the Bidder or another contractor. The following Agreements apply to this call for tenders: Canadian Free Trade Agreement Agreement on the liberalization of public procurement in Quebec and New Brunswick Quebec - Ontario Trade and Cooperation Agreement GUARANTEE Bid bond 10%. Performance bond and materials and services of 50% each required with submission. No verbal information is binding on the Owner and may not be interpreted as modifying the Tender Documents. ELIGIBILITY CONDITIONS Failure of a Bidder to meet any of the eligibility conditions described in this call for tenders renders it ineligible for submission of a Bid. To this end, the Bidder: o and its employees must have the necessary qualifications, authorizations, permits, licenses, registrations, certificates, accreditations and attestations; More particularly and without limiting the generality of the foregoing, the Bidder: o must hold a general contractor's license suitable for carrying out the work in accordance with the Building Act, CQLR c B-1.1; o must employ a Project Manager and a Superintendent who will both be fully assigned to the Project and both must, if they are: a) Construction worker, have at least ten (10) years of experience on construction sites in Quebec, including four (4) years as a superintendent or project manager as the case may be, on construction projects b) Technician in a field related to construction, have at least eight (8) years of experience on construction sites in Quebec, including four (4) years as superintendent or project manager as the case may be, on construction projects . c) Architect or engineer, have at least five (5) years of experience on construction sites in Quebec, including three (3) years as a superintendent or project manager as the case may be, on construction projects. o in addition, the Bidder: must demonstrate that it has managed and carried out five (5) environmental rehabilitation projects over the past five (5) years, each of which was greater than $ 1,000,000; must demonstrate that the proposed project manager and superintendent have each coordinated and managed the completion of two (2) environmental rehabilitation projects over the past five (5) years and each of which was greater than $ 1,000,000 to the employment of the Bidder or another contractor. must have requisitioned, completed and signed the Tender Documents in his name only, as indicated in article 1.11; must hold the Certificate from Revenu Quebec, as described in article 1.15; and its administrators must not have taken one or more actions described in the Attestation form relating to the probity of the Bidder (Annex B). The Bidder must sign a declaration to this effect, as specified in article 1.16; must provide a letter of commitment, issued by a Financial Institution, stating that if the Contract is granted and accepted it will issue a performance bond and a bond of the contractor's obligations for pledges, materials and services as defined in section 1.21; must have the insurance coverage specified in article 2.4 or provide a letter of commitment issued by an insurance company stating that if the Contract is granted and accepted, it will issue insurance coverage as described. in Article 2.4; must have in Quebec or in a territory covered by an applicable intergovernmental agreement, an establishment where it carries out its activities on a permanent basis, clearly identified with its name and accessible during normal office hours; must not be entered in the register of enterprises not eligible for public contracts (RENA) or, if it is entered there, their period of ineligibility for public contracts has ended, as detailed in article 1.12; must be a legal person governed by private law, a general, limited or participation partnership or a sole proprietorship; must have the authorization to contract with a public body prior to obtaining a public contract issued by the Public Procurement Authority (AMP), as detailed in article 1.17, if the amount of the Tender l 'required; must meet any other eligibility condition provided for in the Tender Documents. CONFORMITY CONDITIONS Any Submission containing one of the following non-conformities will be deemed non-conforming and will be automatically rejected: Failure to respect the date and time limit set for the reception of Submissions; Form 1 has not been used to present the Bid, as required in article 1.10; the price submitted was not indicated on Form 1, as required in article 1.10; Form 1 has not been signed by an authorized person, as required in section 1.10; an erasure or correction made to the price submitted and not initialed; a conditional or restrictive Submission; the fact that the Submission transmitted electronically was not transmitted through the site or the fact that it is unintelligible, infected or otherwise illegible once its integrity has been established by the site; the Tender which includes an abnormally low price within the meaning of the Regulation respecting construction contracts of public bodies; if the Bidder submits more than one Bid for this call for tenders, all Bids submitted by the Bidder will be automatically rejected. For the purposes of this paragraph, the transmission of the same Submission electronically and on paper is deemed to be a submission of several Submissions; the presentation of a guarantee that does not comply with the required form and conditions; failure to comply with any other compliance condition indicated in the Tender Documents as resulting in the automatic rejection of a Tender. In addition, a Submission sent on paper containing one of the following non-conformities will be deemed non-compliant and will be automatically rejected: Failure to respect the place provided for the reception of Bids; Form 1 has not been returned to the Tender envelope; the Submission has not been presented in an opaque and sealed envelope, as required in article 1.10; Any omission or error other than those referred to in the preceding paragraphs with regard to a Submission will not necessarily result in the rejection of the Submission. The Owner may allow the Bidder to correct it within a period that it determines. The correction made must be to the satisfaction of the Owner and may not result in an increase in the price submitted. In the case of a Submission transmitted electronically whose integrity has not been ascertained, the Tenderer must remedy this irregularity within 2 working days following the notice of default sent by the Owner. Failure of the Bidder to perform within the time limit will result in the rejection of the Bid. A Submission transmitted electronically within the time limit set to remedy the lack of integrity of a previously transmitted Submission replaces the latter as soon as its integrity is ascertained by the Owner. This Submission is then deemed to have been sent before the date and time set for receipt of the Submission. RECEIPT OF SUBMISSIONS Given the COVID-19 pandemic and the concern for the protection of the health of Bidders and the Owner's employees, the Owner prefers that Submissions be transmitted electronically, this transmission can only be done by the intermediary of the site. If the Tenderer must submit his Submission in hard copy, the campus of the École de technologie supérieure being only partially open, he must make an appointment to come and submit his Submission. Appointments for the transmission of a paper Submission can be obtained by writing to: soumissions@etsmtl.ca no later than Friday, November 6, 2020 at 3 p.m. Bidders should take note that appointments will be given on limited time slots due to the partial opening of the campus. The Tenderer must send his Submission electronically via thesite or by courier, by regular mail or in person to the civic address and to the premises mentioned above. Fax or e-mail are not acceptable modes of transmission. Any Submission which does not comply with the conditions set out above will be automatically rejected. Contrary to what is provided for in the last paragraph of article 1.9, the Owner will reject any Submission which is not received by the date and time mentioned above for the presentation of the Submission at the latest. In addition, the Owner is not responsible for delays inherent in the electronic transmission of Bids via site or in the internal transmission of any paper-based shipment that is not received directly at the Supply Department. UNSATISFACTORY PERFORMANCE RATING The Owner reserves the right to refuse any Bidder who, during the two (2) years preceding the opening date of the Bids, has been the subject of an unsatisfactory performance evaluation by the Owner, has failed to follow up on a quote or a contract or has been the subject of a contract termination due to failure to comply with the conditions thereof. FULL SUBMISSION FOR SINGLE AWARD The Owner does not undertake to accept either the lowest or any of the Submissions received, nor to carry out the subject of this call for tenders, nor to carry out only part of it and could, at its sole discretion, not achieve anything in link with this call for tenders without any compensation for the Bidders. Please note: In this document, any term mentioned in the masculine also includes the feminine and vice versa. Likewise, any term mentioned in the singular includes the plural and vice versa.
