This Request for Proposals ("RFP") is issued by the City of Burbank ("City") to, solicit Proposals for a Design-Build Team, led by a qualified and properly licensed contractor, construction manager or joint venture, to design, manage and construct the PARK PLAYGROUND EQUIPMENT REPLACEMENT PROJECT FOR ROBERT E. GROSS, GEORGE IZAY AND MILLER PARKS, with Gross Park Park Playground Equipment Replacement Project for Robert E. Gross, George Izay and Miller Parks. The Work primarily consists of design, engineering, material procurement, construction, and construction management to remove and replace aging play equipment and related play equipment area improvements as more particularly described in the Design and Performance Criteria and Technical Specifications. All Work must be completed within the time frame established for each play equipment project and in the sequence as agreed to with the successful proposer, but in no case, no more than Two Hundred Seventy (270) consecutive calendar days from and including the date for the Notice to Proceed. Procurement Method: City will use a competitive sealed Proposal process for procurement of professional services to determine the most qualified Design-Build Team whose Proposal is determined to be the best value to the City, as more particularly described in the Instructions to Proposers and other RFP Documents. The Lead Design-Build Team member, with overall management responsibility for the Project, whether an individual firm or joint venture, shall be considered the Proposer and shall sign the Proposal Letter. Following evaluation of the Proposals, the City may negotiate the Contract with the Proposer offering the best value to the City or may enter into the Contract with any such Proposer without negotiations as more specifically described in the Instructions to Proposers. The contract will be awarded without discrimination based on race, color, religion, sex, or national origin. All written Proposal Documents must be submitted no later than 2:00 P.M. on the Proposal Date. Proposal Documents submitted after 2:00 P.M. on the Proposal Date will not be accepted. Sealed Proposals shall be plainly marked in the upper left-hand corner with the Proposer's name and address and bear the words "PROPOSAL FOR PLAY EQUIPMENT AND SHADE STRUCTURES PROJECT FOR ROBERT E. GROSS PARK, GEORGE IZAY PARK AND MILLER PARK - RFP No. 1486" followed by the date and hour for submission of Proposals. Proposal Security: The Proposal shall be accompanied by a certified or cashier's check, or by a corporate surety bond which must be in the form furnished by the City in Section 00300, or approved by the City Attorney. Any corporate surety bond not on the City form must be submitted to the Purchasing Division no less than five (5) working days prior to the bid opening to allow for City Attorney review and approval. Any proposal bond not on a City form, and not approved for use by the City Attorney's Office, will cause the Proposal to be deemed non-responsive. All proposal bonds will be in an amount of not less than ten percent (10%) of the total maximum amount of the bid/proposal. Said proposal bond shall be a guarantee that the selected Proposer will, if selected for award of Contract, within fifteen (15) City working days after notice of award, execute the Contract in the required form and furnish satisfactory Faithful Performance and Payment Bonds on forms provided by the City or approved by the City Attorney, each in the amount of one hundred percent (100%) of the proposal price, Insurance Certificates and endorsements in a form acceptable to the City. Said bonds must be satisfactory to the City and must be secured through an authorized agent in the State of California. Acceptance and Rejection of Proposals: The City reserves the right to reject any and all Proposals, or any item or items of the Proposal, and to waive any informalities or technical defects as the interests of the City may require. Such right of waiver shall be exercised for the City by their Purchasing Manager at their discretion. Contract Documents: The Contract Documents shall consist of all documents contained in this Request for Proposal, including but not limited to the Instructions to Proposers, the Proposal including the accompanying forms of Affidavit and Subcontractors Sheet as well as the Contractor IIPP Certification, Faithful Performance and Payment Bonds, Insurance, Statement of Qualifications, Executed Design and Construction Service Agreement and related attachments, General Conditions and any final Design Documents, all on file in the office of the Purchasing Division. All of said Contract Documents are hereby referred to and made a part of this Request for Proposal. Prevailing Wages: In accordance with the provisions of the Labor Code of the State of California, the California Department of Industrial Relations, Division of Labor Statistics, establishes the general prevailing rates of per diem wages and the general prevailing rates of pay for holiday and overtime work for each craft, classification and type of worker needed to execute the City's contracts for public works and improvements. Copies of the Prevailing Rate of Per Diem Wages are on file in the office of the Purchasing Manager for the City of Burbank, at 301 E. Olive Ave. - Suite 305, Burbank, California 91502, and such copies will be made available to any interested party upon request and are also available online . The Proposer to whom the Contract is awarded, and its Subcontractors, are required to pay not less than the prevailing rates of wages as determined by the Department of Industrial Relations to all covered workers employed in the performance of the Work, and the Proposer shall comply with all other requirements as specified in the Labor Code and in conformity with the requirements of Sections 1773 et seq., of the Labor Code. This project is subject to compliance monitoring and enforcement by the Department of Industrial Relations. 8. License and Registration: 8.1 The Proposer/Lead Design-Build Team member, whether a general contractor, construction manager or joint venture, shall hold a valid California CLASS "A - General Engineering Contractor" license on the Proposal Date or, in the case of a joint venture, provide reasonable assurances that it will be properly licensed prior to award of the Contract, which is tentatively scheduled for January 26, 2021. 8.2 Failure of a single entity Proposer to possess the required license on the Proposal Date shall render the Proposal nonresponsive and shall act as a bar to award of the Contract to such Proposer not possessing said license at the time of award. Failure of Subcontractors to possess the required licenses on the Proposal Date shall require Proposer to substitute licensed design professionals and licensed specialty trade contractors prior to award of the Contract without additional cost to the City. 8.3 No contractor or subcontractor may be listed on a bid proposal for a public works project unless registered with the Department of Industrial Relations pursuant to Labor Code Section 1725.5 [with limited exceptions from this requirement for bid purposes only under Labor Code Section 1771.1(a)]. 8.4 No contractor or subcontractor may be awarded a contract for public work on a public works project unless registered with the Department of Industrial Relations pursuant to Labor Code Section 1725.5. 9. Substitution of Securities: Pursuant to Public Contracts Code 22300, the Proposer who receives award of the Contract may, at its sole cost and expense, substitute approved securities equivalent to any retained funds withheld by the City to ensure performance of the Work or, in the alternative, request that the City make payment of retention to an escrow agent. Performance and Payment Bond: The selected Proposer will furnish to the City "Faithful Performance" [Section 00403] and "Payment" [Section 00404] corporate surety bonds on forms furnished by the City or approved by the City Attorney, each in the amount of one hundred percent (100%) of the total Summary Price Proposal. Said bonds must be satisfactory to the City and must be secured through an authorized agent in the State of California. Codes: Except as provided for in this RFP or pursuant to agreement approved by the City Council, the City of Burbank, as a Charter City, is exempt from the provisions of the Public Contract Code. Mandatory Pre-Proposal Conference: There will be a mandatory pre-proposal conference held at in the playground area at Robert Gross Park, located at 2800 Empire Avenue in Burbank, CA 91504 on November 17, 2020, at 10:00 a.m. Proposers are encouraged to visit (on their own) the play equipment areas at each of the three parks, prior to the pre-proposal meeting, to gather sufficient information to assist in proposal preparation. Failure to attend the pre-proposal conference will disqualify your Proposal.
