Bidders shall note the COVID-19 bid opening procedures elaborated. The work includes the furnishing of all labor, materials and equipment necessary to complete maintenance and repair work on the Boroughs water, sanitary sewer, and storm sewer utilities. This scope may include general utility repair or mechanical or electrical repairs at the Boroughs Perry Street Water Treatment Plant, Maple Place Pump Station, Cedar Street Pump Station, water distribution system, sanitary sewer collection system, or stormwater collection system on an on-call basis. Work also includes emergency snow removal services. The successful bidder will be expected to respond to all call-outs, twenty-four (24) hours a day, seven (7) days a week as needed. The successful bidder will be expected to respond and mobilize to all emergency call-outs within two (2) hours of being notified. The successful bidder will be expected to respond and mobilize to all scheduled non-emergency work at a time as agreed to with the Borough. On-call services under the contract will be provided for a period of one (1) year from the execution of the contract with the Boroughs option for a one (1) year extension at the end of the initial year. Bid Opening and COVID-19 Guidelines: All bidders are encouraged to submit bids via certified mail, overnight delivery or drop-off on or before the bid opening date and time. Due to the Municipal Building being closed to the public, hand delivered packages can be deposited 24 hours a day, 7 days a week, in the secure drop mailbox in the front of the Municipal Building. In adherence to the Centers for Disease Control and Prevention recommendations for the handling of delivered documents by Borough employees, the Borough discourages hand delivery of bids on the day of the bid opening, if possible. All persons wishing to attend the public in-person bid opening must abide by the Centers for Disease Control and Prevention and New Jersey Department of Health (NJDOH) guidelines concerning the COVID-19 pandemic. The bid opening will be conducted on the front steps of the Municipal Building. Participants shall not be allowed access to the interior of the building. All participants must maintain a minimum of six feet separation from other attendees and wear a face covering at all times. Masks and/or gloves will be provided to any attendee who needs one. Bid opening in-person attendees who wish to review the submitted bids following the conclusion of the bid opening will be allowed to do so, one person at a time. Each bid must be accompanied by a certified check of not less than ten percent of the bid payable without any conditional endorsement as a guarantee that in case the contract is awarded to the bidder, he will within ten (10) days thereafter execute such contract and furnish satisfactory performance bond. Upon failure to do so, he shall forfeit the bid security as liquidated damages and the acceptance of the bid will be contingent upon the fulfillment of this requirement by the bidder. No interest shall be allowed upon any such certified check. A bid bond in the amount of ten percent of the bid may be substituted for certified check, except the amount of the bid security shall not be less than $500.00 - nor more than $20,000.00. Each bid must be accompanied by a Certificate of Experience and Certificate of Equipment. Each bid must also be accompanied by a certificate of Consent of Surety from a bonding company licensed to do business in the State of New Jersey guaranteeing that if the proposal of the bidder be accepted they will furnish the bond set forth in the Instructions to Bidders and the acceptance of the bid will be contingent upon the fulfillment of this requirement. Evaluation and award of the bid shall involve a thorough review of the Contractors technical capability, corporate experience, quality, past performance, technical plans, schedules, other submittals, and bid prices. The Borough reserves the right to increase or decrease quantities specified in the manner designated in the Specifications. The Borough reserves the right to award this contract based on funds available. Bidders are required to comply with the requirements of the Americans with Disabilities Act (N.J.S.A.10:5-31 et seq.) and Affirmative Action (N.J.A.C. 17:27) and with the disclosure provisions of N.J.S.A. 19:44A-20.13. The successful bidder shall be required to comply with the provisions of the New Jersey Prevailing Wage Act, Chapter 150 of the Laws of 1963, effective January 1, 1964. Bidders shall comply with N.J.S.A. 52:32-44 latest revision, regarding Business Registration with the New Jersey Division of Revenue. During the performance of this contract the Contractor agrees to comply with the requirements of P.L. 1975, c. 127 (N.J.A.C. 17:27), all requirements of the State of New Jersey Worker Health and Safety Act (N.J.A.C. 12:110 et seq.) as amended and the United States Occupational Safety and Health Act (OSHA) (29 CFR 1910), as amended with regard to worker and jobsite safety. No bidder may withdraw his bid for a period of sixty (60) days after the date set for the opening thereof. The successful bidder will be required to furnish a surety company bond in the full amount of the contract price indemnifying the Borough of Keyport, New Jersey for all proceedings, suits or actions of any kind of description and conditional for the faithful performance of the work. The Borough Council of the Borough of Keyport reserves the right to reject any or all bids if in its opinion it is in the best interest of the Borough to do so.
