Site work, paving and new construction of a mixed-use development in Boothbay, Maine. Completed plans call for site work for a playground / park / athletic field; for paving for a playground / park / athletic field; sidewalk / parking lot; sidewalk / parking lot; and water / sewer project.

Bids will only be accepted and opened from Bidders who are registered with the Issuing Offi ce as having received set of the Bidding Documents using the name appearing in the Bid. The Work includes, but is not limited to, the redevelopment of the existing recreational fi elds, playground and parking lot. Specifi cs improvements include construction of a little league baseball fi eld, two multi-purpose fi elds, children's playground, pavilion with public restrooms and public utility connections, new parking lot and site landscaping. Any contract(s) awarded under the Invitation to Bid will be funded, in part, by a Land and Water Conservation Fund (LWCF). Bids will be received for a single prime Contract. The Work shall be substantially complete by a date of October 15, 2022 and ready for fi nal payment by November 15, 2022 as set forth in the Agreement. The Contract Documents may be examined at the following locations on or after 10:00 AM on Friday April 22, 2022. 1. Issuing Offi ce Sebago Technics, Inc 2. Offi ce of the Owner: Town of Boothbay, 7 Corey Lane, Boothbay, ME 04116 Electronic (PDF) copies of the Contract Documents may be obtained by contacting Steve Doe at sdoe@sebagotechnics.com or 207-200-2056. Non-refundable charge for delivery of Bidding Documents: An additional $25 payable to the Engineer. Delivery fee does not apply to Bidding Documents obtained personally at Issuing Offi ce. Credit cards will not be accepted. To be considered a responsive Bidder, the Bidder shall obtain plans and specifi cations electronically (PDF format) or in hard copy from the Issuing Offi ce. The Bid will not be awarded to a Bidder unless a record of obtaining documents from the Issuing Offi ce exists with the Issuing Offi ce in the name of the Bidder that is to appear in the Bid. The date that the Bidding Documents are transmitted by the Issuing Offi ce will be considered the Bidder's date of receipt of the Bidding Documents. Partial sets of Bidding Documents will not be available from the Issuing Offi ce. Neither Owner nor Engineer will be responsible for full or partial sets of Bidding Documents, including Addenda if any, obtained from sources other than the Issuing Offi ce or for modifi cations to the Bidding Documents including electronic conversion. All questions are to be submitted to Engineer in writing. Questions may be transmitted by e-mail to the Engineer at sdoe@sebagotechnics.com. Questions received less than 5 working days prior to the date for opening of Bids may not be answered. Only questions answered by Addenda will be binding. A completed Bid Form, Certifi cation of Contractor Regarding Segregated Facilities, Certifi cation of Bidder Regarding Equal Employment Opportunity Section 3 Affi rmative Action Plan must be submitted with the Bid. No Bid may be withdrawn for 60 days after receipt of Bids unless released by the Owner. The successful bidder must furnish within 10 calendar days after the Notice of Award the required number of copies of the signed Agreement, Insurance Policy and begin execution of this contract within 10 calendar days following the Notice to Proceed. The successful bidder must furnish within 10 calendar days after the Notice of Award Certifi cation of Subcontractor Regarding Segregated Facilities and Certifi cation of Subcontractor regarding equal employment opportunity for subcontracts exceeding $10,000 and a Section 3 Affi rmative Action Plan for subcontracts exceeding $100,000. Upon request by the Town, the Apparent Low Responsive Bidder shall provide evidence, in the form of a bank statement or letter of credit, from a fi nancial institution indicating cash on hand, or available line of credit suffi cient to purchase the materials required to complete the work. Alternatively, the Apparent Low Responsive Bidder shall provide evidence of a line of credit from its vendors suffi cient to purchase the materials to complete the work. The Successful Bidder must comply with the following: Non-discrimination in Employment and Labor Standards: Bidders on this work and all subcontractors will be required to comply with the President's Executive Order No. 11246 (EEO) and the amendments and supplements to that Order regarding affi rmative action and equal employment opportunity. A Compliance Certifi cation Form is required with bid (Supplemental Conditions SC-20 CDBG Program Federal Contract Provisions). Requirements under this Order are detailed in the Bidding Documents. Department of Labor Regulations: The Contractor must comply with all the Safety and Health Regulations (CFR29 Part 1926 and all subsequent amendments) as promulgated by the US Department of Labor on June 24, 1974; the Department of Labor Regulations relating to Copeland "Anti-Kickback Act (18 U.S.C. 874) as supplemented by 29 CFR Part 3; Contract Work Hours and Safety Standards Act (40 U.S.C. 327-330) as supplemented by 29 CFR Part 5, and Occupational Safety and Health Standards (OSHA) (29 CFR Part 1910). Environmental Regulations: The Contractor must comply with all applicable standards, orders, or requirements issued under Section 306 of the Clean Air Act (42 U.S.C. 1857(h)), Section 508 of the Clean Water Act (33 U.S.C. 1368), Executive Order 11738 and Environmental Protection Agency regulations (40 CFR Part 15). Contractors are urged to become familiar with the requirements of these regulations. No Bid may be withdrawn unless released by the Owner. Owner reserves the right to reject any or all Bids, including without limitation, nonconforming, nonresponsive, unbalanced, or conditional Bids. Owner further reserves the right to reject the Bid of any Bidder whom it fi nds, after reasonable inquiry and evaluation, to not be eligible or responsible. Owner may also reject the Bid of any Bidder if Owner believes that it would not be in the best interest of the Project or the public to make an award to that Bidder. Owner also reserves the right to waive any technical or legal defi ciencies and all informalities not involving price, time, or changes in the Work and to negotiate contract terms with the Successful Bidder. The Contractor shall not award work valued at more than fi fty percent (50%) of the Contract Price to Subcontractor's, without prior written approval of the Owner. Site visits and work at the Site may be governed by an Owner safety program. Owner is exempt from Maine state sales taxes on materials and equipment to be incorporated in the Work. (Exemption No. E45982). Said taxes shall not be included in the Bid.
