Site work, paving and new construction of a civil project in Lafayette, New Jersey. Completed plans call for site work for a road / highway; for paving for a road / highway; for the construction of a water / sewer project; and water / sewer project.

The work includes the furnishing of all labor, materials and equipment necessary to complete the work as shown on the Drawings and as described in the Specifications. The project includes construction of a mechanically stabilized earth (MSE) berm; earthwork and soil processing; new landfill liner systems; new leachate pump house and electrical building; new leachate forcemain; new landfill gas piping; roadway; stormwater features; new litter fence; and new landscaping features. Additionally, the work includes the relocation of the following facilities: convenience center, recycling center, compositing area, contractor drop-off area; site roadways; and site utilities. The work shall be completed within 1,095 calendar days of the Contractors receipt of written Notice to Proceed. Documents provided at the links above are only available for review and are not able to be printed. If a prospective Bidder is interested in pursuing the project, the prospective Bidder shall contact Joseph Sesto, P.E. at the SCMUA via email (jsesto@scmua.org) to request an electronic PDF copy of the Contract Documents for a nonrefundable cost of $150. Upon request and receipt of payment, the SCMUA will send a download link for the documents. Bidders interested in visiting the site should contact SCMUA Chief Engineer, Joseph Sesto, P.E. at (973) 579-6998 Extension 103 to schedule. The bid shall be accompanied by a Certificate of Surety on the form included in the Contract Documents, from a surety company licensed to do business in the State of New Jersey and listed on the Federal Treasury List (Environmental Protection Department Circular 570 - Surety Companies Acceptable on Federal Bonds) as required by N.J.A.C. 7:22-3.17 (g), which shall represent that the surety company will provide the Contractor with the required bonds in the sums required in the Contract Documents and in a form satisfactory to the Owner's Attorney and in compliance with the requirements of law. Bidders must use the prepared bid form which is contained in the Contract Documents. Each individual proposal must be separately enclosed in a sealed envelope addressed to the Sussex County Municipal Utilities Authority, 34 South Route 94, Lafayette, New Jersey 07848, marked on the outside with the number of the contract(s) and name of the project being bid on. No bid will be received unless in writing on the forms furnished, and unless accompanied by bid security in the form of a bid bond, cashier's check, or a certified check made payable to the SCMUA in an amount equal to 10% of the amount of the total bid, not to exceed $20,000. The bid shall be accompanied by a Certificate of Surety on the form included in the Contract Documents, from a surety company licensed to do business in the State of New Jersey and listed on the Federal Treasury List (Environmental Protection Department Circular 570 - Surety Companies Acceptable on Federal Bonds) as required by N.J.A.C. 7:22-3.17 (g), which shall represent that the surety company will provide the Contractor with the required bonds in the sums required in the Contract Documents and in a form satisfactory to the Owner's Attorney and in compliance with the requirements of law. All bid security except the security of the three apparent lowest responsible Bidders shall be returned, unless otherwise requested by the Bidder, within ten (10) days after the opening of the bids, Sundays and holidays excepted, and the bids of the Bidders whose bid security is returned shall be considered withdrawn. The Bidder shall comply with the documentation requirements set forth in the Article of the Information for Bidders, entitled, "Bidder Submissions". The successful Bidder will be required to submit bonds and proof of insurance on or before execution of their respective Contracts as explained in the Contract Documents. Bidders are required to comply with all relevant Federal and State Statutes, Rules and Regulations including but not limited to the applicable provisions of Title VI of the Civil Rights Act of 1964, as amended (42 USC 2000d-2000D-4A), the discrimination and affirmative action provisions of N.J.S.A. 10:2-1 through 10:2-4, the New Jersey Law against Discrimination, N.J.S.A. 10:5-1, et seq., the rules and regulations promulgated pursuant thereto, the State requirement for Bidders to supply statements of ownership (N.J.S.A. 52:25-24.2) and the State requirement for submission of the names and addresses of certain subcontractors (N.J.S.A. 40A:11-16). Pursuant to N.J.S.A. 10:5-31 et seq., Bidders are required to comply with the requirements of N.J.A.C. 17:27 related to mandatory Equal Employment Opportunity and Affirmative Action Rules. The SCMUA welcomes and encourages minority and women-owned businesses to participate in the bidding process. Each Bidder must submit with his bid an Ownership Disclosure Statement and is requested to submit with his bid the Non-Collusion Affidavit on the forms included in the Contract Documents. Bidders and their subcontractors of any tier must comply with all applicable provisions of the Public Works Contractor Registration Act (N.J.S.A. 34:11-56.48) and the New Jersey Prevailing Wage Act (N.J.S.A. 34:11-56.25). Pursuant to N.J.S.A. 52:32-44, all business organizations that conduct business with a New Jersey government agency are required to be registered with the State of New Jersey. Bidders and their subcontractors must submit proof that they are registered with the New Jersey Department of Treasury, Division of Revenue by submitting a copy of their Business Registration Certificate prior to Contract award. The work is expected to be funded in part with the funds from the New Jersey Department of Environmental Protection and the New Jersey Environmental Infrastructure Trust. Neither the United States nor the State of New Jersey, the New Jersey Environmental Infrastructure Trust, nor any of their departments, agencies, or employees is, or will be, a party to the Contract or any lower tier contract or subcontract. The Contract or Subcontract will be subject to regulations contained in N.J.A.C. 7:22-3.1 et seq., 4.1 et seq., 5.1 et seq., 9.1 et seq. and 10 et seq., Local Public Contract, Department of Labor Current Wage Rate Determination, Prevailing Wage Act, Contract Work Hours and Safety Standard Act, Copland Act, Davis Bacon Act, Buy American Clause, Debarment and Suspension, and Socially and Economically Disadvantaged (SED) (N.J.A.C. 7:22-9). All bids shall include a commitment to the use of small, minority, women's and labor surplus area businesses and shall be in conformity with N.J.A.C. 7:22-3.17(a) (24) with a goal of not less than 10% participation of small business enterprises owned and controlled by socially and economically disadvantaged individuals (SED's). Contractors shall submit their own SED Utilization Plan to the NJDEP Office of Equal Opportunity and Public Contract Assistance within thirty (30) days of the contract award. The successful Contractor shall also submit SED Participation Monthly Progress Reports (Form OEO-003) to the Project Compliance Officer and shall submit SED Participation Building Phase Quarterly Reports (Form OEO-002) to the Project Compliance Officer and to the Office of Equal Opportunity and Public Contract Assistance, in accordance with N.J.A.C. 7:22-9.12. Further details regarding required SED participation are included in the Information for Bidders and the Supplemental General Conditions. The Authority will evaluate bids and any award will be made to the lowest responsive and responsible Bidder whose bid conforms to the Bid Documents. The Authority reserves the right to reject all bids and to waive any minor informalities therein, all in accordance with the Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq. The qualification and reclassification of Bidders will be subject to the statutory provisions contained in N.J.S.A. 40A:11-25 to 32 (Local Public Contract Law). It is the purpose of this Notice to Bidders to summarize some of the more important provisions of the Contract Documents. Prospective Bidders are cautioned not to rely solely on this summary, but to read the Contract Documents in their entirety.
