The South Carolina Department of Transportation (SCDOT) is soliciting for a Contractor to furnish and deliver Portland Cement Type 1 to specified locations in York, Chester, Fairfield,and Lancaster Counties, per the specifications andrequirements herein.The Contractor shall transfer cement to SCDOT's Stoltz Lowboy Spreader(s). The Spreaders have a maximum capacity of 17 tons; therefore, if the Contractor uses a 25-ton tank it must be unloaded in two stages. Cement shall be transferred to the Spreader within two (2) hours of delivery (transfer time begins after cement arrives to designated site). Contractor must have the resources to accommodate multiple delivery requests simultaneously. Delivery is required within 48 hours after receipt of purchase order. The Agreement, any dispute, claim, or controversy relating to the Agreement, and all the rights and obligations of the parties shall, in all respects, be interpreted, construed, enforced and governed by and underthe laws of the State of South Carolina, except its choice of law rules. As used in this paragraph, the term "Agreement" means any transaction or agreement arising out of, relating to, or contemplated by the solicitation The effective date of this contract is the first day of theMaximum Contract Period as specified on the final statement of award. The initial term of this agreement isone(1)yearfrom the effective date. Regardless, this contract expires no later than the last date stated on the final statement of award At the end of the initial term, and at the end of each renewal term, this contract shall automatically renew for a period of one (1) year, and day(s), unless contractor receives notice that the state elects not to renew the contract at least thirty (30) days prior to the date of renewal.
