Failure to comply with any of these conditions may result in the Bidder being determined non-responsive and therefore, not entitled to the award of this contract. roximate The work shall consist of a pavement overlay on Lowell, River, Bridge, and Canal Streets, installation of approximately 600 feet of new vertical granite curbing on River Street, the construc-tion of 220 linear feet of new concrete sidewalk with granite curb on Congress Street, Portland Street, and Lowell Street, the installation of two decorative light poles, the replacement of a pedestrian traffic system for the Congress Street/Bridge Street intersection, and the adjustment of several manhole covers. All work shall be substantially completed by May 15, 2021. A bid must be accompanied by Bid security made payable to Owner in an amount of 5% of Bidder's maximum bid price and in the form of a certified check or Bid bond issued by surety meeting the requirements of the General Conditions. No bid may be withdrawn for at least 60 days after receipt of bids unless released by the Owner. Bids submitted without Bid Security and completed certification forms will not be considered. This contract is expected to be funded in whole or in part by the State of Maine Department of Environmental Protection (MDEP). Neither the State of Maine nor any of its departments, agencies, or employees is or will be a party to this contract. The word "agency" in the contract documents refers to the MDEP and all other involved funding agencies. The successful Bidder shall perform the work and furnish a Performance and Payment bond, each in the amount of 100% of the Contract price with a corporate surety authorized to do business in the State of Maine. The Contractor shall guarantee all materials and equipment furnished and work performed for a period of one year from the date of substantial completion. The Performance Bond shall remain in full force and in effect through the guarantee period. The contractor must comply with Davis-Bacon (DB) and Davis-Bacon Related Acts (DBRA) as stated in the CWSRF Supplementary Conditions. All laborers and mechanics employed by the contractor and subcontractors on this project shall not be paid less than the prevailing wage rates contained in the wage determination published in the bidding documents. Any laborers and mechanics not listed in the wage determination shall be paid at least as much as the lowest wage rate for other similar trade classifications already contained in the wage determination published in the bidding documents. The Federal Wage Decision Number for this project is ME20210040. The contractor must comply with the Disadvantaged Business Enterprises (DBE) SRF special requirements contained in the Supplementary Conditions. Failure of the successful bidder to complete the pre-award requirements of this program may result in finding that the bidder is non-responsible and therefore not entitled to award of this contract. The Contractor shall comply with the Use of American Iron and Steel requirements on this project. The Town of Rumford reserves the right to reject any or all Bids, to waive any technical or legal deficiencies, to reject any unbalanced bids, to accept any Bid that it may deem to be in the best interests of the Owner, to negotiate the Contract Price with any Bidder, and to omit any item or items deemed advisable for the interest of the Owner.
