Contract management regulations & declarations In accordance with the provisions of article 938.1.2 of the Municipal Code of Quebec (LRQC C27.1), the municipality intends to apply to this call for tenders the various clauses of its contract management regulations. The municipality reserves the right, in the event of non-compliance, to reject the tender, not to conclude the contract or to terminate it if it is demonstrated that the tenderer has not complied with the requirements of the contract management regulations of the municipality. The latter also reserves the right to terminate the contract if the non-compliance is discovered after the contract has been awarded. Tenders must be accompanied by a certified check equal to ten percent (10%) of the amount of the tender, payable to the owner, or a tender bond issued by an insurance company authorized by the Inspector General of Financial Institutions of Quebec or by the Superintendent of Insurance of Canada to act as surety, established at the same amount, valid for a period of one hundred and twenty (120) days from the date of opening of tenders. This tender guarantee must be exchanged at the signing of the contract for a performance guarantee and a guarantee of obligations for wages, materials and services. When these guarantees are in the form of a bond, the amount of each of them corresponds to fifty percent (50%) of the contract price and, when they are in the form of a certified cheque, the amount of each of them corresponds to ten percent (10%) of the contract price.
