Construction of the Moreno Valley March Field Metrolink Station Track and Platform Expansion Project (Project). The Project is described in more detail in the plans and specifications prepared for the Project. Bids shall be valid for one hundred eighty (180) days after the final date for receipt shown above. Bids must be accompanied by cash, a certified or cashier's check, or Bid Bond in favor of the Commission in an amount not less than ten percent (10%) of the submitted Total Lump Sum Bid Price. The successful Bidder will be required to furnish, prior to award of the Contract, a Performance Bond in the amount of one hundred percent (100%) of the Total Lump Sum Bid Price, and a Payment (Material and Labor) Bond in the amount of one hundred percent (100%) of the Total Lump Sum Bid Price, on the form provided and in the manner described in the Bid Documents. Each bond shall be secured from a surety company that meets all State of California bonding requirements, as defined in California Code of Civil Procedure Section 995.120, and that is a California admitted surety insurer. The Commission reserves the right to reject any or all Bids, to waive any informality or irregularity in any Bid received, and to be the sole judge of the merits of the respective Bids received. The award, if made, will be made to the lowest responsible bidder whose bid is determined responsive to the Bid Documents. Bidders are advised that this Contract is a public work for purposes of the California Labor Code, which requires payment of prevailing wages. The Commission has obtained from the Director of the Department of Industrial Relations the general prevailing rate of per diem wages and the general prevailing rate for holiday and overtime work. Said rates will be on file at the Commission office and they will be made available to any interested party upon request. Each Contractor to whom a Contract is awarded must pay the prevailing rates, post copies thereof at the job site and otherwise comply with applicable provisions of the California Labor Code. Attention is directed to the Federal Minimum Wage Requirements set forth in Part "F" of the Contract Documents. As the Project involves federal funds, compliance with DavisBacon Fair Labor Standards Act is required. If there is a difference between the federal minimum wage rates predetermined by the Secretary of Labor and the general state prevailing wage rates determined by the Director of the California Department of Industrial Relations for similar classifications of labor, the Contractor and subcontractors shall pay not less than the higher wage rate. The Commission will not accept lower state wage rates not specifically included in the federal minimum wage determinations. This includes "helper" (or other classifications based on hours of experience) or any other classification not appearing in the federal wage determinations. Where federal wage determinations do not contain the state wage rate determination otherwise available for use by the Contractor and subcontractors, the Contractor and subcontractors shall pay not less than the federal minimum wage rate which most closely approximates the duties of the employees in question. There is no specific DBE contract goal for this project. However, the Commission encourages the participation of DBEs as defined in 49 CFR 26 in the performance of contracts financed, in whole or in part, with federal funds. It is the policy of RCTC to ensure that DBEs, as defined in 49 CFR Part 26, have an equal opportunity to receive and participate in RCTC DOT-assisted contracts. The Project to be awarded pursuant to this procurement is funded in whole or in part with Federal Transit Administration (FTA) funding. Bidders shall also comply with all provisions of the Federal Requirements for Federal Aid Construction Projects, set forth in Part "G" hereof, including, but not limited to, the Buy America Requirements, as well as all other requirements set forth in the Contract Documents. Bidders must submit a Buy America Certificate in accordance with the Federal Requirements. Bidders are advised that if awarded this Contract they will be permitted, at their request and expense and in accordance with Section 22300 of the California Public Contract Code, to substitute securities equivalent to monies withheld by the Commission to insure performance under the Contract. Refer to sections entitled Substitution for Performance Retentions, and the Escrow Agreement for Security Deposits in Lieu of Performance Retention included within the Contract Documents.
