The County requires concrete blocks and concrete block caps in a variety of configurations, facing(s) and dimensions. They typical use for these items in the construction of retaining walls Steuben County reserves as its right, the right to require clarification from bidders for the purpose of assuring a full understanding of the bidder's responsiveness to the solicitation requirements. The bidder shall include a fully executed original bid bond with its submittal. The bid bond shall be issued by a surety company authorized to do business in New York State. The bond shall be in the amount of one thousand dollars ($1,000.00). A certified check, cashiers check, or a bank issued Irrevocable Standby Letter of Credit may be submitted in lieu of a bid bond. The County and the awardee recognize and agree that time is of the essence in this matter and that the County will suffer financial loss if the contracted work is not completed in the specified time. Additionally, both parties recognize the delays, expense and difficulties involved in proving in a legal or arbitration proceeding the actual loss suffered by the County if the work is not completed on time. Accordingly, instead of requiring any such proof, the County and the awardee agree that as liquidated damages for delay (but not as a penalty) the awardee shall pay the County one hundred dollars ($100.00) for each and every calendar day that expires beyond the time period stated herein.
