**As of April 29, 2021, project has not been awarded. The Project consists of constructing a 100,000 Gallon Elevated Tank Project. Bid security shall be furnished in accordance with the Instructions to Bidders. Shady Grove Special Utility District proposes to construct a 100,000 Gallon Elevated Tank. This contract is to be funded through a loan obtained from the Texas Water Development Board (TWDB). There are a number of special provisions for this funding that a bidder, by submitting a bid, acknowledges that the bidder understands, including the following: 1. A contract is contingent upon release of funds from the TWDB. 2. Any contract or contracts awarded under this Invitation for Bids are expected to be funded in part by a loan from the Texas Water Development Board, and shall be referred to as Project #62857. Neither the State of Texas nor any of its departments, agencies, or employees is or will be a party to this Invitation for Bids or any resulting contract. 3. Equal Opportunity in Employment" - All qualified applicants will receive consideration for employment without regard to race, color, religion, sex, or national origin. Bidders on this work will be required to comply with the President's Executive Order No. 11246, as amended by Executive Order 11375, and as supplemented in Department of Labor regulations 41 CFR Part 60. The requirements for bidders and contractors under this order are explained in the specifications. 4. Disadvantaged Business Enterprise (DBE) - This contract is subject to EPA established DBE "fair share" goals. TWDB document "TWDB Disadvantaged Business Enterprise Program Guidance" is included in the bidding documents.This contract is subject to EPA established Disadvantaged Business Enterprise (DBE). 5. This project is subject to American Iron and Steel (AIS) requirements of 33 U.S.C. 1388 for Drinking Water State Revolving Fund projects. 6. Any contracts or subcontracts in excess of $2,000.00 must include, and comply with the provisions of the Davis-bacon Wage Rate Requirements found in TWDB Guidance No. DB-0156. 7. For additional information on Davis-Bacon Wage Rate Requirements and its applicability to this contract, please consult TWDB Guideline No. DB-0156 8. Cashier's check, or an acceptable Bidder's Bond payable to the Shady Grove Special Utility District (District), in an amount of not less than five percent (5%) of the largest possible total for the bid submitted, must accompany the bid. 9. Performance Bond and a Payment bond, each for one hundred percent (100%) of the contract price, will be required. The successful bidder shall also furnish to the District a Maintenance Bond covering defects of material and workmanship for the two years following the District's approval and acceptance of the construction. Shady Grove SUD reserves the right to reject any or all bids and waive any or all irregularities. No bid may be withdrawn until the expiration of sixty (60) days from the date bids are opened.
