Renovation of a water / sewer project in Newberg, Oregon. Completed plans call for the renovation of a water / sewer project.

Bids that do not arrive on time at the Newberg City Hall, or bids without the first tier subcontractor disclosures within two hours of bid opening, will not be accepted for consideration. Proposed construction consists of furnishing all materials, labor, equipment, and supervision for the rehabilitation of Oxidation Ditch No. 1 at the Newberg Wastewater Treatment Plant (WWTP). Construction includes concrete demolition and replacement of segments of the sloped concrete wall in Oxidation Ditch No. 1; installing a test panel of reinforced shotcrete overlay; installing fiber reinforced shotcrete along the remaining sloped concrete walls in Oxidation Ditch No. 1; repair of concrete and cracks identified in the drawings and additional work on concrete segments based on construction observation. The Engineer's estimated construction cost range is $500,000 to $700,000. All bidders shall submit their questions through the same bid management website no later than 4:00 PM on April 12, 2021 so that a Bid Addendum can be issued if needed without altering the bid date. If it becomes necessary to revise or clarify any part of this ITB, written addenda will be provided electronically Bidders must acknowledge receipt of all addenda in the appropriate area of the Bid Documents form, which must be returned as part of the bid. All addenda issued during the bid period will be incorporated into the Contract. No modification or clarification is binding the City unless it is confirmed in a written addendum to this ITB. Construction may begin in June if permitted by weather. Construction shall, however, be substantially complete by August 26, 2021. All construction shall be fully complete by September 23, 2021. All bidders shall be licensed with the Construction Contractors Board (CCB) as required by ORS 701.035 to 701.055. The contractor and subcontractors are not required to be licensed for asbestos abatement under ORS 468A.720. Before starting work on the project, the contractor must have a public works bond filed with CCB and all subcontracts shall also include a provision requiring all subcontractors to file a public works bond with CCB, unless exempt under ORS 279C.836 (4), (7), (8) or (9). In addition, all bidders shall be compliant with all tax laws and the successful bidder shall carry Workers' Compensation and Unemployment Insurance in accordance with ORS 656.001 through 656.794. To be eligible for contract award, all bidders must submit a prequalification application to the City's Project Manager no later than April 12, 2021. Bidders must all be prequalified for these classifications of work: Demolition and related Excavation and Clearing. The City's prequalification application form is available at online Bidders shall include the following additional documentations with their prequalification application forms: 1. Proof of Experience: Contractor shall list two similar projects with project names, a short narrative of each project scope, procurement type, engineer's contract information and owner's contact information; and 2. Safety Information: Provide your Experience Modification Rating (EMR) from 2017 - 2020 and your Recordable Incident Rate (RIR) for 2017 - 2020. Only EMR's 1.0 or less and RIR's 2.0 or less will be acceptable. Contractors who are not prequalified and cannot meet the minimum requirements listed above will be considered non-responsive and their bids shall be rejected. This is a public works project subject to BOLI prevailing wage rates required by ORS 279C.800 to 279C.870. By signing the bid, the bidder agrees to comply with those provisions which state that workers on public works projects shall be paid not less than the current Region 3 prevailing rate of wage Each bid must be submitted on the prescribed form furnished in the bid document completely filled out and signed, in a sealed envelope, clearly marked that it is a bid, and have the bidder's name and the project title on the outside of the envelope. Each bid must be accompanied by a certified check or bid bond payable to the City of Newberg, Oregon, in an amount of not less than ten percent (10%) of the total amount of the bid submitted. Include a fully executed Non-Collusion Affidavit and First-Tier Disclosure Form. Each bid must identify whether the bidder is a resident bidder, as defined in ORS 279A.120. The City of Newberg reserves the right to reject any bid not in compliance with all prescribed public bidding procedures and requirements and to reject for good cause any or all bids on a finding of the City that it is in the public interest to do so; and to accept the bid which is in the best interest of the City. No bidders may withdraw their bids for a period of sixty (60) calendar days after the date set for opening. Any bid protest shall be in accordance with OAR 137-049-0260 and OAR 137-049-0450, as applicable. Award of the contract under this ITB will be made to the lowest bidder whose bid substantially complies with the terms set forth in this ITB, who is a "responsible bidder" under the criteria set forth in ORS 279C.375(3), and who is in compliance with any other required public procurement procedures or terms. When applicable, all bidding shall comply with President's Executive Order No. 11246. All bidders shall comply with the applicable provisions of the Equal Employment Opportunity Act of 1972 and the Civil Rights Act of 1964. The successful bidder will be required to obtain a City of Newberg Business License prior to performing work within the City limits; furnish Performance and Payment bonds from a surety for faithful performance of the contract in the full amount of the contract price; and comply with Oregon's Equal Pay Act.
