Site work for a water / sewer project in Bay City, Texas. Completed plans call for site work for a water / sewer project.

The City is issuing this Invitation to Submit Proposals to select a single entity to provide turnkey installation and support of an Advanced Metering Infrastructure (AMI) system, which includes the complete replacement of the City's existing water meters with new meters equipped with endpoints, Network as a Service (NaaS), and headend system (i.e., meter data management, interface with the City's existing billing system, meter data analytics, customer interface, etc.) for a total AMI system that meets the City's project goals. Any contract or contracts awarded under this project are expected to be funded in part by a loan from the Texas Water Development Board. This contract is contingent upon release of funds from the Texas Water Development Board (TWDB). Any contract(s) awarded under this Invitation for Bids is/are expected to be funded in part by a loan or loan with principal forgiveness from the TWDB and a grant from the United States Environmental Protection Agency, U.S. EPA. Neither the State of Texas, the U.S. EPA, nor any of its departments, agencies, or employees, are or will be a party to this Invitation to Submit CSPs or any resulting contract. Davis Bacon prevailing wage requirements apply to the construction, alteration or repair of treatment works carried out, in whole or in part, with assistance made available by a State water pollution control revolving fund and to any construction project carried out in whole or in part by assistance made available by a drinking water treatment revolving loan fund. All laborers and mechanics employed by contractors and subcontractors on projects funded directly by or assisted in whole or in part by and through the Federal Government shall be paid wages at rates not less than those prevailing on projects of a character similar in the locality as determined by the Secretary of Labor in accordance with subchapter IV of Chapter 31 of Title 40, United States Code. For additional information on Davis-Bacon Wage Rate Requirements and its applicability to this contract, please consult TWDB Guidance No. DB-0156 Any contract(s) awarded under this Invitation to Submit CSPs is/are subject to the American Iron and Steel (AIS) requirements of federal law, including federal appropriation acts and Section 1452(a)(4) of the Safe Drinking Water Act (42 U.S.C. 300j-12(a)(4)), as applicable. Offerors on this work will be required to comply with the President's Executive Order No. 11246, as amended by Executive Order No. 11375 and Executive Order No. 13672, in the award and administration of contracts awarded under TWDB financial assistance agreements. Failure by the Contractor to carry out these requirements is a material breach, which may result in the termination of awarded financial assistance. Each bidder shall furnish a bid guarantee equivalent to five percent of the bid price (Water Code 17.183). If a bid bond is provided, the Contractor shall utilize a surety company which is authorized to do business in Texas in accordance with Surety Bonds and Related Instruments, Chapter 3503 of the Insurance Code. A governmental entity may not award a governmental contract to a nonresident bidder unless the nonresident underbids the lowest bid submitted by a responsible resident bidder by an amount that is not less than the amount by which a resident bidder would be required to underbid the nonresident bidder to obtain a comparable contract in the state in which the nonresident's principal place of business is located. A nonresident bidder is a Contractor whose corporate offices or principal place of business is outside of the state of Texas (Source: Texas Government Code, Chapter 2252, Subchapter A, Nonresident Bidders, 2252.002). Proposals shall be accompanied by a cashier's or certified check upon a national or state bank in an amount of five percent (5%) of the total maximum proposal price payable without recourse to the Owner, or a proposal bond in the same amount from a reliable surety company, as a guarantee that the Offeror will enter into a contract and execute performance and payment bonds within fifteen (15) days after notice of award of Contract to him. Such proposal guarantee shall be made payable to CITY OF BAY CITY. The successful Offeror must furnish a performance, payment, and maintenance bond upon the form provided in the amount of one hundred percent (100%) of the contract price from an approved surety company holding a permit from the State of Texas to act as surety, or other surety or sureties acceptable to the Owner. Proposals must remain in effect for 60 days after the proposal opening date. Within 60 days from the proposal date, the Owner may award the contract to the Offeror that submits the proposal that offers the best value to the Owner or reject any or all proposals for the project. The CITY OF BAY CITY reserves the right to reject any or all proposals, to waive irregularities in the proposals deemed to be in the best interests of the CITY OF BAY CITY, and to reject nonconforming, nonresponsive, or conditional proposals.
