For construction of Wastewater Treatment Improvements The scope of WORK generally consists of installing Contractor assigned wastewater equipment (MBBR, Blowers, Aeration, and UV Disinfection Equipment) and furnishing and installing approximately 4,500 feet of 3-inch, 4-inch and 10- inch force main, 1,800 feet of 12-inch and 16-inch gravity sewer, two 18'x18' cast in place concrete tanks, precast concrete buildings, manhole & concrete structures, plug valves, and electrical work, dewatering, testing, site work, and cleanup and all appurtenances as required by the Project Drawings, Specifications, and Contract Documents. The project is located one (1) mile south of the City of Fort Pierre, South Dakota in Central South Dakota. Each BID must be accompanied by a separate envelope containing a BIDDER's Bond equal to ten percent or Certified Check or Cashier's Check in a sum equal to five percent of the full amount of the BID, executed by the BIDDER as Principal and by a SURETY, conditioned that if the Principal's BID is accepted and the CONTRACT awarded to the Principal, the Principal, within fifteen days after notice of award, shall execute a CONTRACT in accordance with terms of the BID and a CONTRACTOR's BOND as required by law and the regulations and determinations of City of Fort Pierre, South Dakota. Bidders on this work will be required to comply with the Presidents Executive Order Nos. 11246 as amended, 11458, 11518, and 11625 as amended. The requirements for bidders and contractors under these orders are explained in the specifications. The Contractor is advised that the funding and/or regulatory agency for this project is the State of South Dakota (Environmental Funding Program). Davis Bacon and Related Acts wages and American Iron and Steel Provisions apply to this project. All provisions related to those acts must be met. The Contractor shall also comply with the requirements of Public Law 115-232, Section 889, Prohibition on Certain Telecommunications and Video Surveillance Services or Equipment. The requirements under this law are explained in the specifications. Bidders on this work will be required to comply with Title 40 CFR 33 and Executive Order Nos. 12138. The requirements for bidders and contractors under this regulation which concerns utilization of Disadvantaged/Minority Business Enterprises (DBE/MBE) and Women's Business Enterprises (WBE) are explained in the contract documents. The goal for MBE is 1.0% of the total dollar value of the project. The goal for WBE is 4.0% of the total dollar value of the project. Owner reserves the right to reject any and all Bids. Award, if made, shall be to the lowest responsible Bidder whose Bid is responsive to the invitation and is most advantageous to the Owner, in its sole and exclusive discretion, price and other factors considered. The Owner may reject a Bid as nonresponsive if the prices bid are materially unbalanced between the line items or subline items. A Bid is materially unbalanced when it is based on prices significantly less than cost for some work and prices which are significantly overstated in relation to cost for other work, and if there is a reasonable doubt that the bid will result in the lowest overall cost to the Owner even though it may be the low evaluated bid, or if it is so unbalanced as to be tantamount to allowing an advance payment. The Owner also reserves the right to waive all information not involving price, time or changes in the Goods and Special Services, and to negotiate contract terms with Successful Bidder.
