Furnish all labor, materials and equipment and perform all work required for the prevention of environmental pollution in conformance with applicable laws and regulations, during and as the result of construction operations under this Contract. For the purpose of this Section, environmental pollution is defined as the presence of chemical, physical, or biological elements or agents which adversely affect human health or welfare; unfavorably alter ecological balances of importance to human life; affect other species of importance to man; or degrade the utility of the environment for aesthetic and/or recreational purposes. All questions about the meaning or intent of the Contract Documents shall be received in writing by CDM Smith, 260 West Exchange Street, Providence, Rhode Island 02903 Attn: Roger Norton, at least five days before the date set herein for the opening of bids. OWNER and ENGINEER in making copies of Contract Documents available do so only for the purpose of obtaining Bids on the Work and do not confer a license or grant for any other use. The undersigned hereby agrees that the Contract Time shall commence ten days following the Effective Date of the Agreement and to fully complete the Work within 150 Calendar Days, in accordance with the terms as stated in the Agreement. The undersigned further agrees to pay OWNER, as liquidated damages, $1,500.00 per day for each calendar day beyond the Contract Time Limit or extension thereof that the Work remains incomplete, in accordance with the terms of the Agreement. The Owner reserves the right to waive any informality in or to reject any or all Bids if deemed to be in its best interest.
