Prequalification of Prospective Bidders Compton Unified School District ("District") has determined that bidders who submit bids on the above-referenced project must be prequalified. Required Licensure The District is seeking to prequalify contractors with the following licenses: "A" and/or "B" licenses that intend to bid as a general contractor (prime contractor) directly to the District, and first-tier subcontractors with "C-16" licenses. Completion of Prequalification Application. Any prospective bidder who does not submit the required information using the Prequalification Application and/or any attempt to use an alternative form by a bidder shall be disregarded by the District. All blanks and requested information in the Prequalification Application must be appropriately filled in and all required documents and attachments must be provided. The District reserves the right to reject any Prequalification Application if all of the information is not furnished by the bidder. It is each bidder's sole responsibility to ensure its Prequalification Application is fully and completely filled out, timely delivered and received at the location designated in the Prequalification Application. Any Prequalification Application received after the scheduled time for receipt shall be rejected. All Prequalification Applications shall be completed by the date and time set forth above. Any interested party is solely responsible for ensuring its prequalification application is completed by the deadline set forth above and is fully complete and responsive. The District shall not be responsible for any delays or errors in submission. All interested parties must take all steps necessary to ensure their Prequalification Application is completed in a timely manner and delivered to the District. Prequalification to bid on the project listed is required irrespective of, and in addition to, any prequalification for any other District work already on file. The District reserves the right to reject any or all responses to the Prequalification Application and to waive any non-material irregularities in any response received. Upon completing its review of the Prequalification Applications and making its determination of the pre-qualified bidders, the District will provide notification in writing to those bidders who were determined to be pre-qualified and those who were not pre-qualified. References Each firm must provide Contractor Project References and Contractor Building Information Modeling (BIM) Project references as specified for each tier in the pre-qualification application. General Contractor: All projects the Firm has participated as a contractor or first-tier subcontractor during the past ten (10) years with Firm contract value of at least $150,000,000 and all Contractor Building Information Modeling (BIM) projects with a Firm contract value of more than $100,000,000. PLEASE NOTE: Four (4) of the California K-12 public school projects must each have a value of at least $50,000,000 within the past ten (10) years. First-Tier Subcontractor: All projects the Firm has participated as a contractor or first-tier subcontractor during the past ten (10) years with Firm contract value of more than $5,000,000 and all Contractor BIM projects with a Firm contract value of more than $2,000,000. PLEASE NOTE: Four (4) of the California K-12 public school projects must each have a value of at least $1,500,000 within the past ten (10) years. District will make efforts to contact and receive responses from the bidder's references within ten (10) business days of the bidder submitting the Prequalification Application. To the extent the identified references fail to respond within this 10-day period, the District has the right to determine that the references identified by the bidder are not responsive, do not constitute a passing score, and constitute grounds for denial of pre-qualification to the bidder. Brief Description of the Project Project includes, but is not limited to, the following: Reconstructing the Compton High School campus which will include state-of-the-art classrooms, fine arts and sports facilities that will benefit the students and community of Compton as a replacement High School Facility. All existing buildings to be demolished and replaced with a two-story, type II-B Academic Building (92,500 SF), steel structure - steel special moment frame with SidePlate connections, a one-story Performance Arts Center, type II-B (38,100 SF), steel structure with steel buckling brace frames and steel trusses, a one story Gymnasium and locker building, type II-B (42,132 SF) with steel buckling restrained brace frames and steel roof trusses, a new swimming pool and support structure, a track and field stadium and bleachers with 390 SF press box, a visitor's concessions and toilet building, new tennis and basketball courts, new lunch shelter and new parking lots. Measure S Community Benefits Agreement (CBA) The District has adopted the Measure S Community Benefits Agreement (CBA) and is included in the District's agreement with the Bidder. The goal of the CBA is to identify and retain skilled labor, employ District residents, encourage small local business, project cooperation, workers' compensation carve-out and peaceful resolution of all labor disputes. The CBA is included as an Exhibit in the Request for Bid (RFB) Documents to be issued. Labor Compliance Requirements All contractors must comply with all applicable labor compliance requirements under the California Labor Code, including but not limited to, registration with the Department of Industrial Relations (Labor Code Sections 1771.1(a) and 1725.5), 1771, 1771.4, 1773.2, 1774, 1776, 1777.5, 1813, and 1815. Pursuant to California Labor Code Section 1771.1(a), as amended by SB 854, a contractor may not bid, nor be listed as a subcontractor, for any bid proposal submitted for public work or engage in the performance of any contract for public work unless registered and qualified to perform public work pursuant to Labor Code Section 1725.5, subject to limited legal exceptions. Section 1771.1(a) states as follows: "A contractor or subcontractor shall not be qualified to bid on, be listed in a bid proposal, subject to the requirements of Section 4104 of the Public Contract Code, or engage in the performance of any contract for public work, as defined in this chapter, unless currently registered and qualified to perform public work pursuant to Section 1725.5 It is not a violation of this section for an unregistered contractor to submit a bid that is authorized by Section 7029.1 of the Business & Professions Code or by Section 10164 or 20103.5 of the Public Contract Code, provided the contractor is registered to perform public work pursuant to Section 1725.5 at the time the contract is awarded." As a result, no contractor or subcontractor may be listed on a bid proposal for a public works project unless registered with DIR. To comply with the DIR guidelines, the District will disqualify any contractor (and subcontractor) who is not registered with the DIR at the time the bid (or prequalification) package is opened, the award will go to the next low responsible bidder who is registered with the DIR. All contractors and subcontractors must furnish electronic certified payroll records directly to the Labor Commissioner (aka Division of Labor Standards Enforcement). This project will be subject to compliance monitoring and enforcement by the DIR, pursuant to California Labor Code Section 1771.4. In addition to submitting certified payroll records directly to the Labor Commissioner, the awarded contractor must also provide one original set of certified payroll records to the District's Purchasing Department. Appeal Procedures Where the District finds the bidder to not be prequalified as a result of the bidder's answers to the Prequalification Application, the bidder will receive a written response from the District explaining the District's decision. To the extent a timely and complete Prequalification Application has been submitted by the bidder, then the bidder can submit a written notice of appeal to the District. The appeal must be submitted by the bidder in writing within ten (10) business days after receipt of the District's decision and such appeal shall (i) a written statement by the bidder of all the grounds supporting the bidder's appeal and (ii) all documentation relied upon by the bidder to support its appeal. If the bidder fails to submit a timely or incomplete appeal, the bidder waives, released and relinquishes any and all rights to challenge the District's decision, whether by administrative process, judicial process, or any other legal process or proceeding. If the bidder gives the required notice of appeal and requests a hearing, the hearing shall be conducted so that it is concluded no later than five (5) business days after District's receipt of the notice of appeal, and no later than five (5) business days prior to the last date for the receipt of bids on the project. The hearing shall be an informal process conducted by a panel to whom the District has delegated responsibility to hear such appeals (the "Appeals Panel"). At or prior to the hearing, the bidder will be advised of the basis for the District's pre-qualification determination. The bidder will be given the opportunity to present information and present reasons in opposition to the District's determination. Within one (1) business day after the conclusion of the informal appeal hearing, the Appeals Panel will render its decision in writing. It is the intention of the District that the date for the submission and opening of bids will not be delayed or postponed to allow for completion of an appeal process. The decision by the District's Appeals Panel shall be final and not appealable to the District. A bidder who is not satisfied with the final decision of the District, shall file any legal challenge to the District's decision within fifteen (15) calendar days from receipt of the District's Appeals Panel decision. The District may award the contract to another bidder despite the pendency of an Appeal and any legal filing or procedure.
