Work shall begin on the date fixed in the Notice to Proceed and be substantially complete within 120 calendar days after the Notice to Proceed Date. The Owner will suffer financial loss if the Work is not completed within the time specified herein, plus any extension thereof allowed in accordance with paragraph 5.7 of the General Conditions. The Owner and the Contractor recognize the delays, expense, and difficulties involved in proving, in a legal or arbitration proceeding, the actual loss suffered by the Owner if the work is not complete on time. Accordingly, instead of requiring any such proof, the Owner and the Contractor agree that as liquidated damages for delay (but not as a penalty) the Contractor shall pay the Owner Two Hundred and Fifty dollars ($250.00) for each day that expires after the time specified herein for completion until the Work is complete. In case full payment for the Work shall have been made, the Owner shall have the right to recover from the Contractor and the Contractors surety the amount of such liquidated damages as determined under this Contract.
