NARRAGANSETT BAY COMMISSION ERNEST STREET PUMPING STATION PHASE 1 - VALVES, FLOW METERS, AND OTHER MISCELLANEOUS IMPROVEMENTS 204.00C NOTICE TO BIDDERS Separate sealed Bids for Narragansett Bay Commission Ernest Street Pumping Station Phase 1 - Valves, Flow Meters, and Other Miscellaneous Improvements 204.00C, addressed to the Narragansett Bay Commission will be received at the Narragansett Bay Commission, NBC Corporate Office Building, 1 Service Road, Providence, RI 02905, until 2:00 PM prevailing time on April 27, 2023 at which time and place the bids will be publicly opened and read aloud. Award will be on the basis of the lowest responsive, responsible and eligible bidder. The bidder must submit a copy of their bids for public inspection upon the opening of the bids. The work generally consists of installation of eight fabricated stainless steel slide gates in the pump suction of the wet well to replace existing isolation knife gate valves on the inlet side of the pump systems; removing the existing pump suction wet well isolation gates (SG-16 and SG-17) and replacing them with new fabricated stainless steel slide gates; removing the existing pump discharge butterfly valves (BV-1 through BV-8) and replacing them with new in-kind; removing the existing pump discharge flow meters (FE-16 through FE-23) and replacing them with new meters; install new suspended grating platforms above the influent wet wells to provide operator access to the new isolation gate valves; remove the gates and seal valve bodies for suction and discharge isolation knife gate valves (KGV-1 through KGV-16), as indicated on the Drawings and as specified. The Ernest Street Pumping Station facility is to remain in operation during construction, with limited isolation available for individual pump systems to conduct the work, and for brief, controlled outages to isolate pump systems. Each Bidder shall agree to fully complete the Project, including all punch list items, within 730 consecutive calendar days from the date stipulated in the Notice-to-Proceed to commence "Work". Each Bidder further agrees to pay delay damages as specified in the Agreement. This bid security shall be in the form and subject to the conditions provided in the Information for Bidders. Successful bidder must furnish 100 percent Performance Bond and 100 percent Payment Bond. Attention of Bidders is particularly referred to the State requirements as to conditions of employment to be observed and wage rates to be paid under the Contract as on file in the Rhode Island Department of Labor, Office of the Director. All terms, conditions, and provisions of Chapters 12 and 13 of Title 37, General Laws of Rhode Island, 1956 as amended, shall apply to all bidders, and the provisions of said Chapters 12 and 13 of Title 37, General Laws of Rhode Island, 1956, as amended, are incorporated herein by reference thereto. The Bidder's attention is called to the Equal Opportunity Clause and the Standard Federal Equal Employment Opportunity Construction Contract Specifications set forth herein. This project is subject to Chapter 37-14.1 of the Rhode Island General Laws and regulations promulgated there under, which require that ten percent (10%) of the dollar value of work performed on the project be performed by minority and/or women's business enterprises. The successful Bidder will be required to provide the maximum practicable opportunity to small and minority business enterprises to participate in this Contract. Bidders on this work will be required to comply with the President's Executive Order No. 11246 and amendments or supplements to the Executive Order and EPA Form 5720-4. 1. The Bidder's attention is called to the "Equal Opportunity Clause" and the "Standard Federal Equal Employment Specifications" set forth herein. 2. The goals and timetables for minority and female participation, expressed in percentage terms for the Contractor's aggregate workforce in each trade on all construction work in the covered area, are as follows: Timetables Goals for minority Goals for female participation participation for each trade in each trade 3.0% 6.9% These goals are applicable to all the Contractor's construction work (whether or not it is federal or federally assisted) performed in the covered area. If the contractor performs construction work in a geographical area located outside of the covered area, it shall apply the goals established for such geographical area where the work is actually performed. With regard to this second area, the contractor also is subject to the goals for both its federally involved and nonfederally involved construction. The Contractor's compliance with the Executive Order and regulations in 41 CFR Part 60-4 shall be based on its implementation of the Equal Opportunity Clause, specific affirmative action obligations required by the specifications set forth in 41 CFR 60-4.3(a) and its efforts to meet the goals established for the geographical area where the contract resulting from this solicitation is to be performed. The hours of minority and female employment and training must be substantially uniform throughout the length of the contract, and in each trade, and the contractor shall make a good faith effort to employ minorities and women evenly on each of its projects. The transfer of minority or female employees or trainees from Contractor to Contractor or from project to project for the sole purpose of meeting the Contractor's goals shall be a violation of the contract, the Executive Order and the regulations in 41 CFR Part 60-4. Compliance with the goals will be measured against the total work hours performed. 3. The Contractor shall provide written notification to the Director of the Office of Federal Contract Compliance Programs within 10 working days of award of any construction subcontract in excess of $10,000 at any tier for construction work under the contract resulting from this solicitation. The notification shall list the name, address and telephone number of the subcontractor; employer identification number of the subcontractor; estimated dollar amount of the subcontract; estimated starting and completion dates of the subcontract; and the geographical area in which the contract is to performed. 4. As used in this Notice, and in the contract resulting from this solicitation, the "covered area" is Providence, Rhode Island in Providence County. No Bidder may withdraw his bid within 90-calendar days after the actual date of the openings thereof. The Owner reserves the right to waive any informality and/or to reject any or all bids. A pre-bid conference will be held at 9:00 a.m. prevailing time on April 4, 2023 at the NBC Corporate Office Building, 1 Service Road, Providence, RI. The meeting place is accessible. There will be a site visit to the facility immediately following the pre-bid conference. Individuals requesting interpreter services for the hearing impaired must notify the Narragansett Bay Commission office at (401) 461-8848/TDD (401) 461-6549, at least 72 hours in advance of the meeting date. The Engineer will review and consolidate questions received before the deadline, prepare written answers, and respond by Addenda sent at least four days prior to the receipt of Bids to those prospective bidders known to have taken out sets of the Contract Documents CONDITIONS OF WORK Each bidder must inform himself fully of the conditions relating to the construction and labor under which the work is now or will be performed; failure to do so will not relieve the successful bidder of his obligation to furnish all materials and all labor necessary to carry out the provisions of the Contract Documents and to complete the contemplated work for the consideration set forth in his bid. Insofar as possible, the Contractor, in the carrying out of his work, shall employ such methods or means as will not cause any interruption of or interference with: the operation of the existing treatment facilities; sewer; traffic; use of existing utilities and structures affecting the work or other similar conditions at the site, character of equipment and facilities needed preliminary to and during prosecution of the work; requirements of owners and controlling authorities having jurisdiction over the various lands, existing structures, facilities, and utilities; and all other conditions affecting the work to be done, and the labor and materials needed; and he shall make his bid in sole reliance thereon; and shall not, at any time after submission of a bid, assert that there was any misunderstanding in regard to the nature or amount of the work to be done.
