In accordance with the provisions of California Public Contract Code $ 3300, and Business and Professions Code $ 7028.15(e), the City of St. Helena has determined that the contractor shall possess a valid Class A contractors license at the time that the contract is awarded. Failure to possess the specified license shall render a bidders bid as non-responsive and shall bar award of the contract to any bidder not possessing the specified license at the time of the award. All contractors doing work within the City of St. Helena are required to have a City business license. California State prevailing wage rates will be required on this project. This Project is subject to compliance monitoring and enforcement by the Department of Industrial Relations. Cash, a certified check or bank draft, payable to the order of CITY OF ST. HELENA, negotiable U.S. Government bonds (at par value), or a satisfactory bid bond executed by the Bidder and acceptable surety, in an amount equal to ten percent (10%) of the total of bid, shall be submitted with each bid. The successful bidder shall be required to furnish a Performance Bond in an amount equal to 100% of the contract price and a Labor and Material Bond in an amount equal to 100% of the contract price. Each bond shall be in the forms set forth herein, shall be secured from a surety company that meets all State of California bonding requirements, as defined in California Code of Civil Procedure Section 995.120, and that is a California admitted surety insurer. In accordance with Section 22300 of the Public Contracts Code, securities may be substituted for monies withheld to ensure performance under this contract. This project has a construction contract DBE goal of 9%. The bid submission package shall contain a completed and signed form 15-G detailing the contract DBE goal commitment. If the commitment is less than 9% of base bid, a completed and signed form 15-H is also required. The City of St. Helena reserves the right to postpone the date and time for the opening of proposals at any time prior to the date and time announced in the advertisement in accordance with applicable law. The City of St. Helena reserves the right to reject any and all bids or to waive any defects or irregularity in bidding in accordance with applicable law. In accordance with California Public Contract Code Section 20103.8, if the City elects to award a contract for performance of the project, the contract will be awarded in accordance with California Public Contract Code Section 20162 and other applicable law to the responsible bidder submitting a responsive bid with the lowest total bid price for the base bid without consideration of the bid price for any additive or deductive items. All bids will remain valid for 90 days after the bid opening. Except as permitted by law and subject to all applicable remedies, including forfeiture of bidder security, bidders may not withdraw their bid during the 90 day period after the bid opening.
