Bid prices submitted shall include furnishing all labor, equipment and materials to complete the project as described above and as shown on drawings 31-354-01, 02, 03, & 04. Bidders shall use the proposal form provided in this Request. Payment shall be made to the contractor upon satisfactory completion ofthe work, as deemed by the City Engineer; therefore, no bonds are required and no progress payments made. By entering into this contract, the contractor agrees to provide a 100% warranty for a period on ONE (1) year against material or workmanship defects and will fully replace the defects at the contractor's cost and the City Engineers direction. The City ofHagerstown anticipates award ofthis contract on September 28, 2021, and that a Notice to Proceed will be issued on or about November 1, 2021. The contractor shall complete all the work outlined within thirty (30) working days after the Notice to Proceed date. The contractor shall provide Insurances to protect the City ofHagerstown per the attached Insurance Requirements for Independent Contractors. The City ofHagerstown reserves the right to reject or accept any or all Proposals submitted, either in whole or in part for any reason within its absolute discretion and to re-advertise ifit deems necessary. The City further reserves the right to waive any informalities. The City ofHagerstown Engineering Department Office is the sole entity authorized to provide this RFP package to interested companies or individuals. Firms who are working from an RFP package obtained from any other source may have an incomplete set of documents. The City assumes no responsibilityfor any error, omission, or misinterpretation resultingfrom a company's use ofan incomplete RFPpackage. Firms who have received the RFP package from a source other than the City Department ofParks and Engineering Office are advised to contact the office to provide their company name, mailing address, telephone number, fax number, contact name and contact e-mail address. This will ensure that the company receives all RFP related communications and documents, including addenda. There may be one or more addendums to this solicitation.
